And it really wouldn't be the governments problem HOWEVER, we are talking about state schools here and money is 100% involved. When one or more states are involved, it's automatically a federal issue. This still means that private operations like the NFL and MLB should be left alone by the federal government unless it's clear they're breaking federal laws.

The BCS could be seen as operating in such a way as to exclude rival 'national championships' with lock-ins to conferences and specific bowls. It might actually be an interesting legal case if he felt like pursuing it. And for those who are unaware, Teddy Roosevelt was also a major player in shaping college football rules, holding a 'summit' while he was in office to 'save' college football.

So why not football? and every student athlete fails out of every class? I don't think so. If i'm not mistaken most teams have GPA rules, or rules that say "if you fail a class, you don't play"

Top level players will only go to schools that can get them to the national championship game and increase their exposure, therefore they sure as hell won't go to conference USA. However if there was a tournament, they may instead to go schools where they can get more playing time and possibly even start as a true freshman. So basically they can't get into the national championship because they really can't compete for top recruits and they can't compete for top recruits because they can't compete for the national championship.
I mention Tulsa specifially because in 2007 they beat Bowling Green 63-7, setting the record for poins scored in a bowl game. They became the first team in NCAA history to have a 5,000 yard passer (Paul Smith), a 1,000 yard rusher (Tarrion Adams), and three 1,000 yard receivers (Brennan Marion, Trae Johnson, and Charles Clay) all in the same season. With all that firepower, the best that they're allowed to do is the GMAC Bowl?
