So, basically, you want a system that pretty much NEVER allows "the little guy" with not much money to sue a big company, since they won't want to take chances on their better lawyers finding a loophole that allows them to win, and then bankrupt them? You would never get your day in court unless you had a smoking gun that would end any and all doubt that you were in the right. So instead of "proponderance of evidence" to win a case, people would feel they need 100% proof just to START a case.
My god...Diggers are usually aso anti-big corporation. But you are championing a law change that would be 100% FOR big corporations. Big corporations could completely run wild over hte little guy with almost no fear of lawsuits.

Related is the reason corporations are constantly seeking to ban class-action lawsuits.
