So, basically, you want a system that pretty much NEVER allows "the little guy" with not much money to sue a big company, since they won't want to take chances on their better lawyers finding a loophole that allows them to win, and then bankrupt them? You would never get your day in court unless you had a smoking gun that would end any and all doubt that you were in the right. So instead of "proponderance of evidence" to win a case, people would feel they need 100% proof just to START a case.
My god...Diggers are usually aso anti-big corporation. But you are championing a law change that would be 100% FOR big corporations. Big corporations could completely run wild over hte little guy with almost no fear of lawsuits.

For every "hot coffee lawsuit," there are dozens of strategic lawsuits by corporations to drain the financial resources of their opponents, business or otherwise. Related is the reason corporations are constantly seeking to ban class-action lawsuits.
