When I first came here(I am Australian), many people told me that the law was written to advantage the wealthy. I didn't really understand it until the new drink driving laws came in(with a 0.01 blood alcohol limit!).
Drink driving is endemic in Brazil & I was talking with friends, none of whom had changed their habits at all. When I asked why, I found out what they meant about the law advantaging the wealthy:
Step 1 - You could pulled over(very rare here) & asked to submit to a roadside breathtest
Step 2 for the poor - You have no choice & submit & if you are over you are charged
Step 2 for the wealthy - You call your lawyer(on your mobile phone) & have him speak to the police. He tells them that you won't submit to potentially providing evidence against yourself without him present. By law, the police then have no choice but to take you to a hospital & meet your lawyer there.
Step 3 - Your lawyer asks how many drinks you have had, calculates how long it will take for that alcohol to dissipate in your system & delays his arrival at the hospital for that amount of time(4-6 hours isn't a problem!), where you then submit to the test & are(surpise surprise) under the limit.
This now has the effect of the police rarely bothering to pill over more expensive cars for breath testing as they know it'll take up the rest of their night standing around at a hospital & lead to no charge. - FairDinkumMate, on 04/10/2009, -0/+2I live in Brazil & that certainly isn't the attitude among my friends & colleagues here. Please don't throw out the baby with the bathwater. Yes, America exports some not so positive attitudes & examples(especially for & to developing nations) but the idea that justice is for all, not just the wealthy is an excellent message that this dedicated woman took to the indigineous people of the Amazon.
