- PlanckTime, on 05/19/2009, -1/+1211. The government basically stole it by insisting that the taxes on it had to be paid in person by either Robert E. Lee or his wife. During the Civil War, while Lee was the leader of the Confederate Army.
Congress refused to let them pay remotely, and when neither of them showed up to pay in person (unsurprisingly) Congress confiscated the land for themselves (again, not a surprise). They later (much later) admitted their culpability and paid Lee's descendant for the property. Arlington didn't belong to Lee, but to his wife.

- PlanckTime, on 05/19/2009, -0/+4The problem is that it was not done through a court of law. Congress didn't take it under the auspices of eminent domain. At the time, Congress was insisting that the southern states were still part of the union, so they would still have enjoyed Constitutional protection.
Instead, Congress basically gave Lee and his family the finger and decided either they could take the family's property illegally, or they could get either Lee himself or his wife as a hostage were they dumb enough to show up.
As I stated in my post, Congress later admitted that it had acted wrongly and apologized and gave money to the descendants. Whatever Lee may have been doing, Congress still acted wrongly. - Koushiro, on 05/19/2009, -0/+4Veteran's Day is in November.

It was common law that one had to pay taxes in person back then. So, who is at fault?
Also, I think it was around 1883 when the Government decided that Lee's son was the rightful owner of the land. He, instead of making the Government remove the bodies, gladly accepted a $150,000 payment in return for the land. The list clearly stated that there were 4 Medal of Honor recipients IN SECTION 27. Audie Murphy is in section 46 and was white.
