Last I checked, nonrecognition treatment does not apply to a nonsimultaneous exchange of property unless (1) the property received by the taxpayer is identified within 45 days of the transfer of the property relinquished by the taxpayer [I.R.C. § 1031(a)(3)(A)]; or (2) the property is received by the taxpayer on or before the earlier of the day that is 180 days after the transfer of the relinquished property, or the due date (including extensions) of the taxpayer's tax return for the year in which the relinquished property is transferred [I.R.C. § 1031(a)(3)(B)].
