If they don't plan on charging you, you can leave. Also, you don't HAVE to answer the police officer. All it takes is patience and self-will.
One of the oldest tricks in the book(reporters use it all the time) is to ask a simple question, wait for the answer, and just stare at the person for a second. I come back my mom is balling they searched my room made it a mess and pulled out all of my pocket knives I've collected(I love being outdoors). They missed my shotgun and pellett gun. And they made me immediatly come to the station after a 6 hour drive and little sleep over the last week I was pissed. So I came in and was interogated for 3 hours FOR NOTHING. They even took my finger prints like i was a ***** criminal. Lets look at my ***** criminal history.....oh wait THERE IS NOTHING. WHAT THE *****. Why would I want some coins how could I do it if I was in canada and WHY THE ***** ARE YOU TREATING ME LIKE A CRIMINAL.

I haven't gotten a ticket since and have been pulled over about 5-6 times since then.

Also: make sure you close doors and windows when you leave your vehicle since they'll have to go through another grouping of laws if they still want to search through your car. It's as simple as that. Be cautious, know you have rights, and be respectful.

In the example in the movie the officer did not have probable cause to search the car. He might have a hunch, based on kids going to a concert that they had marijuana in the car. A hunch is not enough.
The officer might have been able to arrest the driver on the traffic violation (depends on laws in the jurisdiction). Once the dirver is arrested the officer could have searched the car and the contents of the backpack. Unlikely an officer would do that.
The officer could also "frisk" the car if he has a reasonable suspicion there were weapons inside. Nothing here would give the officer reasonable suspicion.
So, yes the officer can search the car without a warrant but he cannot search on a whim. He must have reasons and in the video the officer did not have reasons. - flazz, on 10/12/2007, -1/+7hey, those were Darryl's videos.

Wow, interesting about the staring after a question thing. That must be why my boss does that whenever he asks me a question? He's trying to get me to trip or something. I once said back to him "Uhhh....are we having a staring contest?" and he got embaressed, like I had noticed his tactic, and then he carried on with whatever he was talking about.

Seriously, I had to wait once while the police dog searched "near" my car, and somehow indicated there was something in the car (there wasn't), but that was their "probably cause" for searching my car wihtout consent. Of course they didn't find anything. I wish had a better understanding of my rights back then... - Moocat, on 10/12/2007, -0/+5They've tried pushing through the "smelling" thing I hear by training cops on the odor of weed (I wonder how they do that? :P). However, this rarely, if ever, holds up in court without the backup of visible substance. The key point is, hide your stuff, or don't bring it along. Or don't do it.

I knew I had the right to say no, but I figured that if I allowed them to search and they found nothing, it would look better for my case. (thankfully they didn't find anything!!)
Always remember you have the right to say know, even though most cops will try and make it seem like you are doing a bad thing if you don't let them search. I don't drink or do drugs, so when the officer repeatedly asked me if I had anything to drink I stated " I don't drink.." and "Finally.." I don't drink.." in such a way he could see my disgust at the thought.
Even though I had my right hand hid at all times...he let me go.
