Support this artist's fight and support the rights of all artists by spreading the word. Let StockArt.com, and any stock website, know that copyright infringement is a very big problem and that they have a responsibility to find out the truth and who the actual original owner is - not to bill, harass and ruin reputations of artists.

He should fight it to the very end. Not only should the stock website be forced to drop the case but they should be accountable for any fees suffered by Engle.
After that he should sue the ***** out of the law firm for defamation. What right do they have to go out, search for his customer base, then make such bias accusations against him?
And ***** shame on his customers. Getting a call out of the blue with serious allegations and not even bothering to follow up or get info from the other side?! Boy, that just screams responsibility. /s
I'd advice him to get as much date info from the stock website ASAP. They might try and change everything to support their case. But let's consider for a second what happens when you catch someone out, they never just come out and admit it the first time, and they usually make a big noise and it takes a while before the truth comes out. In a lot of cases, they'll bully you in an attempt to make it seem as though you're actually in the wrong and try and make you back down.
Well Jon, that's exactly what this stock site is doing. Don't you dare back down. You have enough people backing you on this one that you don't have to worry about having to 'go it alone'

Pretty stupid if you ask me.

Knowing that it's YOUR work being stolen is bad enough, but when they claim ORIGINAL OWNERSHIP of YOUR work, then it's beyond a nightmare, especially since they want him to pay $18,000 for his own hard labor. I'm sure that the artist will prevail in this case, since there's timestamps all over everything.

If it were me in his place I would have told the lawyer very promptly to ***** off and in those exact words as well. I would have secondly countersued for theft and any subsequent profit they made from selling the stolen artwork. You want to sue ME for work I created? Alright have fun when I countersue you for theft,fraud,defamation etc to the tune of 10-100x your claim. I'd also have the original sketches and other such material to backup my claim, what would they have? nothing more than an upload that they can't prove was made by them. The site will get ***** over in court that's a gaurentee.

- elitebox, on 04/05/2009, -0/+34This experience should be a reminder for artists to submit their work to the Library of Congress ASAP after designing. You can always assign your rights to someone else later.
Some thoughts for the artist: You should get a very good lawyer ASAP and file counterclaims for libel, defamation, and IIED. Also, file for declaratory relief of non-infringement. Make sure your attorney files sanctions against the other party's legal counsel. Use the discovery process to find out everything you can about this company and how they stole your artwork. Demand a trial by jury.
