Official Rules
- Eligibility: To be eligible for this Digg, Inc. ("Digg") contest, you must (a) be a current member of the Digg website (http://digg.com) in good standing, (b) have uploaded to the contest microsite (http://digg.com/contest) all Flash animations ("Animations") you would like considered for this contest no later than 8 pm PST on Wednesday, May 16th, 2007, and (c) be 13 years of age and older and a legal resident of the United States for the duration of the contest. Minors between the ages of 13 and 17 must first obtain the consent of their parent or legal guardian in order to enter. If the prize is won by a minor, it will be awarded to a parent or legal guardian on the minors' behalf. Each member of Digg can submit up to three (3) entries per account. Full-time Digg employees and members of their immediate families are not eligible for this contest. Digg may reject any submitted entries that it determines, in its sole and absolute discretion, fail to meet any of these eligibility requirements. To be eligible you must agree to abide by these terms and conditions and be bound by all Digg decisions relating to this contest, which are final and binding in all respects, including but not limited to Digg’s determination of the winners.
- Duration: The contest begins on Thursday, April 19th, 2007 at 8 pm PST and ends on Wednesday, May 16th, 2007 at 8 pm PST.
- Prize Criteria: Animations will be judged and ranked for the Finalist Prizes based on creativity, usefulness, effective display of data, and use of the Digg API as determined by Digg in its sole discretion. Ranking of the Animations for the Finalist Prizes is based on the decision of a panel of judges (the "Judges") and their decision is final. Without limiting the foregoing, any Animations containing unlawful, profane, threatening, defamatory, sexually explicit or hateful content will be immediately disqualified. Each and every eligible Animation is entered to win a Finalist Prize, so it is possible that one participant could win multiple Finalist Prizes. Only the Animations receiving Finalist Prizes will be eligible to win a Grand Prize. Each Prize winner will be required to complete and submit the Affidavit of Eligibility provided by Digg. If a Prize winner fails to complete and submit the Affidavit of Eligibility as specified above within ten (10) days of Prize notification, or if a Prize winner is disqualified or held to be ineligible in the sole discretion of Digg, the corresponding Prize will be awarded to the participant with the next highest ranking.
- Prize Date: A list of all Finalist Prize winners will be posted on the Digg website on Thursday, May 24th, 2007. A list of all Grand Prize winners will be posted on the Digg website on Thursday, May 31st, 2007.
- Prizes: There are a total of 13 prizes to be awarded. The top 10 ranked Animations, as determined by the Digg contest Judges, receive a finalist prize ("Finalist Prize"). No more than one Animation can earn a single ranking. Of the Animations receiving Finalist Prizes, the top 3 Animations, as determined by the number of votes cast online by Digg users, will also receive a grand prize ("Grand Prize"). In the event of a tie, the contest Judges will choose the winner. Finalist Prizes and Grand Prizes are collectively referred to as "Prizes". Prizes are not exchangeable, transferable or redeemable for cash. In the event of unavailability of stated Prizes, Digg reserves the right to substitute a prize of comparable value.
- Restrictions: This contest is void where prohibited or restricted by any relevant federal, state or local law, including but not limited to jurisdictions with laws that would require registration, disclosure, filing, trust account or posting of a bond, or any other requirements that are not satisfied.
- Limitation on Liability: Notwithstanding anything to the contrary, neither Digg, nor any supplier, employee, director or agent shall be liable under any legal or equitable theory for (a) any technical or human error which may occur in the process of submitting Animations that may limit your ability to participate in this contest, (b) failure of your Animation submission to be included in the contest, or (c) any injuries, losses or damages caused by a Prize awarded (or failed to be awarded) in the contest or participation in the contest.
- Warranty Disclaimer: The Prizes are provided on an AS IS basis, and Digg disclaims all warranties, whether express or implied, with respect thereto or to any other subject matter of these terms and conditions.
- Release and Publicity: You hereby forever release and grant Digg the right to use and disclose your name and Animation in connection with the Digg website or any Digg promotion of the contest results or related publicity, including, without limitation, a press release. You hereby acknowledge and agree that Digg is hereby granted a non-exclusive, worldwide, royalty-free, transferable right to display, perform, use, reproduce, modify, distribute and provide users access to all Animations (including all related intellectual property rights) in connection with the Digg services and Digg website. Digg will credit you as the developer of the Animation in a manner that Digg reasonably determines.
- Assignment: The Prizes are not assignable or transferable by you without written consent from Digg. Digg may freely assign and delegate its obligations hereunder.
- Other Terms: Digg is the sponsor of this contest. This contest is governed by and shall be construed under the laws of the State of California, USA, without regard to its conflict of laws provisions. The parties hereby irrevocably consent to exclusive jurisdiction and venue in the state and federal courts of San Francisco, California. If any provision of these terms and conditions is held to be illegal or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that these rules shall otherwise remain in full force and effect and enforceable to the fullest extent permitted by applicable law. Digg reserves the right, at its sole discretion, to disqualify any individual found tampering or otherwise interfering with the contest. If Digg determines, in its sole discretion, that the contest is compromised by any corruption of the administration, security, or proper play of this contest then, at Digg’s sole discretion, it may cancel the contest. The winners will be subject to, and responsible for, all applicable U.S. taxes and withholding. The odds of winning depend on the number of eligible Animations on the award date.
