I am a filmmaker, and I have seen friends arrested for shooting films in public with fake guns. Walking up and down an interstate is not a good thing to do regardless of what you're wearing. It's hard to tell the real thing and a Halloween prop apart driving by at 65. It still could have been *funny* without the gun, and the reactions could be judged as more sincere on the part of passing motorists and the police if he didn't have any probable cause for them to take him down.

The poster of this story is a ***** idiot who posted it with a misleading headline. Whether or not the propaganda is intentional is really irrelevant. Second he should have KNOWN this was coming. You ask "Can I see that?" then use special police deductive powers, and recognize that the weapon is not functional at all.
If you're concerned about your safety, then you can use the squad car's loudspeaker to ask them to drop the weapon.

It is illegal, however, to be a pedestrian on an interstate. The particular area of 295 where he was caught is actually very dangerous as the road doesn't really have shoulders, just guard rails.
- avester, on 10/12/2007, -0/+2they didn't think that they found osama bin laden they thought they found some nut job on the side of the road with a rifle. given the roadside snipers that have happened not to long ago I would say it is a stupid thing to be walking around the side of the road with anything that might be mistaken for a real gun. and the guy was still obviosly disturbing the public and could have caused an accident if some driver reacted the wrong way. if it was me I wouldn't risk being sued by a driver who got in an accident for not removing him.

Your freedom of speech is not being violated - you have crossed the line and violated the rights of others.
Whether you were intending to kill those people is irrelevant. Whether your accoutrements actually had the capability to kill people is irrelevant. You are causing fear, menacing people in a situation where they can legitimately interpret your actions and words as real.

- dukrous, on 10/12/2007, -0/+2Having a toy or real gun on your person is not illegal, so long as you have the proper carry permits. Brandishing a toy or real gun on a highway (which depending on the road is either state or federal ground), is illegal. It's a misdemeanor since he was not putting anyone in mortal danger, but it is still an arrestable offense and automatically brought up on charges. Chances are he'll be brought up for endangering the peace or some other 2-3 month offense and receive a couple months probation and possibly some community service.

In and of itself, having a gun or a fake toy gun in public may not be illegal, but inducing panic is. Was the gun brandished? This was near a highway- how visible was he, and how many people called the police about him? From what the officer in the video, said, it sounded like more than one person may have called, but I'm not sure.

He was holding up a sign saying "I Love TABOR", which is a huge tax referendum that certain people are trying to pass. It is a hotly contested issue in this state. And I think he was successful in getting his message across - that TABOR is evil. In no way was he making fun of 9/11.
