As soon as the bank sets up the repo, she no longer OWNS the car...the bank does. Used to, if you fought to keep it (like, fought the repo man) you would be charged with robbery. Now, must states have pussified their laws so much its hard to repo men to do their jobs. He's not saying that throwing the woman on the ground is "pussified" He's saying that BECAUSE the laws have been pussified so much, there really is no recourse against the woman if she puts up a fight. So really, because the laws are the way they are, he's left with pretty much no alternative.
Frankly, I agree with him fully. I don't have any sympathy for people who buy cars they can't afford and then can't pay them. It's not like the bank repos your car immediately. First, he spots the target. Second, drive a block away (because the equipment is loud as hell) and engage the hidden tow equipment in the bed of the truck. Third, drive up, hook on, and away he goes. If it was, he could have just called the police and enforced the order. If it wasn't, the secured party, or their repo agent, can only proceed without breach of the peace...which it was clear that they did not here.

It was strict policy that if there was any confrontation from the (previous) owner that we were to leave the vehicle and/or call the Sheriff's department for assistance. Physical confrontations were to be avoided at all costs for two reasons: 1) You could end up hurt or killed, and 2) the potential for a lawsuit or jail becomes very high once things get physical.

IANAL mind you, but the woman may very well have a case in court.

"As an unusual provision of law, when repossession takes place, the lienholder has a nondelegatable obligation not to cause a breach of the peace in performing the reposession, or the repossession will be reversed, and the party ordering the reposession will be liable for damages (this provision is unusual in that where a duty can be delegated to an agent, usually the agent is responsible for the misconduct, but the princpal who hired the agent is not responsible for the agent's misconduct). This requirement means that whether a reposession is performed by the lienholder or by an agent, the reposessor must not cause a breach of the peace or the lienholder will be held resonsible. This requirement not to breach the peace includes even if the breach is caused by, say, the debtor objecting to the reposession or resists the repossession. In the court case of MBank El Paso v. Sanchez, 836 S.W.2d 151, where a hired reposessor towed away a car even after the registered owner locked herself in it, the court decided that this was an unlawful breach of the peace and declared the reposession invalid. The debtor was also awarded $1,200,000 in damages from the bank."
To be toosed out of a car like that during a reposession may well be a "breach of the peace in performing the repossession" that can have lead to injuries to the whoman that are liable for damage. You know, its actually really easy to drag a car, especially if you lift the wheels in front (direction of travel) of the center of gravity.
Think of a bicycle. Tires are the same front and back. However, you can slam on the rear brake and lock it up, while slamming on the front brake will throw you over the bars. Its also why a on a car, its the front brakes that really stop you, the rear brakes serve more of a control function.
Trucks with hidden wheel lifts are common for repo guys, and what alot of repo guys will do, depending on the area, is get the car, snatch it, and drag it away quickly. If the car is in park and the drive wheels are on the ground, or if the parking brake is on, they will squeal like hell, but they can generally get a block or 2 away really quick, stop, unlock the car and disengage the brake, put it in neutral, secure the wheels, and get out of there. Even if they blow a tire pulling it away, they can just switch ends. As far as the bank is concerned, a little damage during the repo is acceptable. - oxdeltaxo, on 10/11/2007, -0/+4Considering the entire economy is based on debt, the repo man is just part of what keeps the system from sliding into recession. Although if people didn't buy things, they couldn't afford outright in the first place, people wouldn't be in debt and no one would feel stupid for letting the repo man take away those things. If a breach of the peace occurs, the repo man's privilege to get the car has been lost. He is liable in tort for tresspass, conversion, etc. if he continues. If this happens all the time, then the repo man can get the sheriff and then the SHERIFF can use that kind of force.
IANAL (yet), but I just had a bar review lecture on Article 9 of the UCC which covers secured tranactions. I miss big-boys.com :( - dogfuddddd, on 07/14/2009, -0/+1ok first and foremost in every state if the car is registered to someone that car is property of that person regaurdless of the ***** bank. next what that ass did was assult and the woman could have him arrested. and sue his ass. next when someone whose name is on any property says leave now. its required by law they do so. or they can be shot. i know because i have been fighting the ***** repo guys for 6 months why, not because i don't pay my bills but because i bought the car outright and the guy i bought it from filed a lost title and got a new one and i bought it and got title. well the bank obviously didn;t get their money well guess what they aren't touching my ***** car. and if they do i do three things first is show them the title with my name on it. 2nd i tell them to leave from my front lawn and 3rd if they refuse i fire a 12 gauge round into the air and let them know thats the warning shot i am required to give in the make my day law. leave or die. and they leave everytime. heres the point your repo ***** are worthless and are car thieves and thats it. i PAYED my bills and if the bank didn't get their ***** money its not my fault go after the ***** that didn't leave our cars alone.

My father used to own a bank and did most of the repo work himself. He wasnt as hardcore as some of the guys you hear about, he usually took the stuff when the person was gone and never really had any bad confrontations.
But he said you get some repo guys that are absolutely rediculous. You give them an assignment and they dont even care about doing it peacefully. They drive up and take whatever they want, and god help your soul if you want to mess with them. Doesnt matter if its in a rough area, if you have a man beast defending it, its all the same to them. They are supposedly up there on the list of guys you never, ever, want to mess with. - jamesmcneil, on 10/11/2007, -1/+2wow... I saw this on you-tube about a year ago or so when I got into repo, 1 things for sure he shouldn't of pushed her that hard, I have been in many situations like this and have gotten out of everyone with the car and leaving the r/o with a little dignity. To be a good repo man.........stealth is the key,...the less stories the better, this superman ***** will get you put in jail. In his defense, I get women like this all the time,... most often its black women,....I don't really understand it just making an observation. I love my job but at the same time I understand that most people are not bad people and should be treated right, as in how he tried to initially. I have been investigated a few times for misconduct but have always came out on top, for this reason.
