- AmyVernon, on 07/13/2009, -7/+839I'd think that Guinness would have been better off thanking FAILBlog for pointing out its idiocy and fixing the page in question. But noooooo

- xirfan, on 07/13/2009, -3/+371it links you to the FBI website.
- Surferess, on 07/13/2009, -5/+363I just love when people post private letters like this. It is the ultimate payback.
- inactive, on 07/13/2009, -19/+348Booooo Guinness Yay Fail...
- DiggsUnder, on 07/13/2009, -14/+334talk about corporate bullying
- greeniemeani, on 07/13/2009, -10/+273The full legal response is much more detailed and funny. Everyone should check it out.
- NewsFeed, on 07/13/2009, -8/+229I always love it when someone stands up to these crap letters. Welcome to the Webernet suckers :)
- rebotfc, on 07/13/2009, -3/+223So what happens when you click "Break this Record" ?
- Burento, on 07/13/2009, -3/+189Before the Blur... http://imgur.com/G9qQt.jpg
- EnTaroTassadar, on 07/13/2009, -9/+185Would Failblog set the record for "Pissing off the most record book publishers in a single instance"?
- Animan351, on 07/13/2009, -2/+156damn you. It's been a while.
- storstygg, on 07/13/2009, -2/+131I will still drink their beer.
- UncleHenry, on 07/13/2009, -1/+115The full response had me rolling with laughter.
- jivemasta, on 07/13/2009, -3/+113Wouldn't it be fair use since they are using the images as a parody?
- inactive, on 07/13/2009, -7/+117This is why I hate corporate culture at every level. It has no ***** soul, no ***** empathy. We wonder why people are so cut throat in this world, it's so that we can gain our freedom from ***** like these.
- bearcat8543, on 07/13/2009, -8/+107the fact that the Guiness World Record legal department is going to get rick roll'd is epic.
- thejackyl, on 07/13/2009, -3/+101They send you a box of improvised explosives and a note that says "good luck".
- ultraseamus, on 07/13/2009, -2/+90Heh, this is the first I have heard of this. Law departments need to get together with marketing departments more often. So often companies magnify bad press by demanding it be removed.
- SquigglyP, on 07/13/2009, -2/+87hate to break the news to you, buddy...
- Falldog, on 07/13/2009, -4/+88Back in my day, fail used to mean something. We also took the time to type y and o too.
- StuartGibson, on 07/13/2009, -3/+75And commentary.
- Animan351, on 07/13/2009, -2/+74damn it, now I gotta go back and read some more...
- Tenareth, on 07/13/2009, -1/+69Damnit, and I didn't even follow the link until I saw this comment...
- mmm_linux, on 07/13/2009, -2/+67this is not twitter.
- Yarkz, on 07/13/2009, -3/+62Do YOU have the rights to use their logo?
- TheNyquilKid, on 07/13/2009, -3/+62Don't worry they are working to break their own record with a special addition rape section.
- bluekarasu, on 07/13/2009, -1/+54High quality screenshot here : http://content.ytmnd.com/content/c/f/5/cf50726b992 ...
- Ugotownedo, on 07/14/2009, -0/+506 star wanted level.
- pinguz, on 07/13/2009, -0/+49great response, failblog never lets me down
- DiggaStoleMyBik, on 07/14/2009, -1/+49Failyo?
- Mujokan, on 07/13/2009, -2/+47I would guess it is fair use. Otherwise every time a McDonald's logo appeared on the news the network would be sued. Bear in mind this is about a trademark not a copyright. I would guess it would fall under this: http://en.wikipedia.org/wiki/Nominative_use
- pathouston22, on 07/13/2009, -9/+523 buildings instead of 2 fall down.
- Hraes, on 07/14/2009, -1/+44That's stupid. He clearly meant "yofail".
- RiperSnifle, on 07/13/2009, -2/+44You are put on every black list ever.
- inactive, on 07/13/2009, -7/+47Alex Jones gets material for another 10 years.
- twiztidsinz, on 07/13/2009, -4/+43Holy ***** *****..
Learn to spell. - DBeta, on 07/13/2009, -2/+41But this isn't a misuse of trademark. The point in a trademark is to protect the brand from being impersonated. In this case it is very clear that the failblog is not GBWR and is not trying to be. They took a screenshot of the page in it's entirety in full context. They were not using the brand to promote their site nor to impersonate Guinness. I'll be honest and say I've never read all the laws around trademark, but I do understand the point, and if what failblog did was in any way a violation of the law, the law is stupid and should be changed.
- DiggsUnder, on 07/13/2009, -4/+42just as on digg content (videos/ pics) on failblog are user submitted
- jake1337, on 07/13/2009, -5/+41They send all teh party vans to your doorz
- smacksaw, on 07/13/2009, -5/+39Fair use.
- mikeyernst, on 07/13/2009, -0/+34to be fair, this is a screenshot from a old version of the guinness website. their current website doesn't have the "break this record" option under each record.
not that they aren't douchebags anyway. - jessemoya, on 07/13/2009, -15/+47For the stupid few who are on the GBWR side, I'd like to introduce you to the Streisand Effect:
http://en.wikipedia.org/wiki/Streisand_effect
Also, a couple of you sound like you're part of the anti-Pirate Bay or GBWR legal teams. If you're not, yet somehow defending them, then I kindly suggest you kill yourselves. - DarkShadow791, on 07/13/2009, -2/+3309 F9 11 02 9D 74 E3 5B D8 41 56 C5 63 56 88 C0
oh, wait... - a7r3ides, on 07/13/2009, -0/+31very insightful and witty.
- jdsee, on 07/13/2009, -1/+30You, sir, have picked the entirely wrong website to voice this opinion on.
- lutafin, on 07/13/2009, -1/+30Just to spell? to think as well, *****.
- AnotherBrian, on 07/13/2009, -0/+28It's absolutely fair use (commentary).
The Mythbusters cover logos because the companies aren't paying them for product placement, especially if a competing brand is. It's a bit of an unethical situation. -
