Also many artists would say they are inspired by other artists. The Mencia jokes were clearly stolen with very little alteration from multiple comedians while this is just a couple jokes that are somewhat similar. I'm not a huge fan of Dane Cook but I am going to say I don't buy this as stolen material.

@Nodren - I've heard dates given by Jimmy Norton on O&A and Louis CK was doing these jokes on TV Specials long before Dane cook did them. I remember the getting hit by a car one specifically talked about. (As owingsro pointed out below: "All the Louie CK jokes were all on his 2001 HBO special. Honestly, who hasn't thought of a situation like the bike/car/person scenario. The punch lines were different, the context different. I know that they're similar, but that doesn't necessarily make it plagiarism. Who hasn't thought about naming their kids weird names? Who hasn't had an itchy *****. All these things are funny and merit jokes, unfortunately we'd all probably come up with something quite similar.

I think all the stuff he got big on was that kool-aid guy routine and such. Plus, I remember that hit-by-a-car routine went on for a while too. And I would say if anything he's funny because of his delivery. His jokes aren't particularly funny, it's just the way he tells them. Anyone else trying to do his material would just sound stupid. Far more appalling than the Cook/CK and Mencia stuff. Hicks and Leary were friends and Leary just about copied his act. They were not friends after this, and then Hicks died of pancreatic cancer.

Dane Cook had been seen hanging around when CK was performing these jokes. So he obviously had heard them before. He wasn't sitting around in 2004, writing and forming new jokes. He was remembering jokes he had seen performed before and tweaking them so they wouldn't sound EXACTLY the same.

I remember a couple years ago when Dane Cook was still small time and it wasn't "popular" to hate him. I think I liked it better back then, when I could show his dvd to people that hadn't even heard of him and every single person loved his entire act. I've seen him a few times live and I still think he is absolutely hilarious. I think the haters just hate because it's the in thing to do now that he's so well known. Seems to me that all these comedians are just recycling someone else's material.

The other problem I see for these "known" comedians is that they are touring comedy clubs all the time. He simply yells and repeats everything and it just isn't funny. Whether or not he steals material, which it seems he does, he is not funny.

I whoever said Pablo Francisco deserved the attention more-I'm totally with you on that!!! Pablo is the man. He comes up with stuff right there on stage. Truly a funny guy.
As for all this stealing, I think people are just looking too deeply into something that is just not there. I could not see anything that could be considered stealing in the audio clips provided. Just general topics. And Danes delievery just makes his better anyway.

Take any 2 comedians body of work and look hard enough you can claim theft on probably 75% of the material. - dnite, on 10/12/2007, -1/+1I can understand the Carlos Mencia thing. His jokes are pretty much word for word. Sure. But this is stupid. I saw this a while ago and thought it was dumb back then, but in light of recent events, I decided to give it another chance.
First off, I love both of these comics. Louis CK and Dane Cook are both extremely hilarious comedians. With that said, these 3 jokes are just about the same general topics. There are no real specific similarities other than, 'a joke about naming you kids', 'a joke about someone getting hit by a car' and 'a joke about an itchy ass hole' .. that's it. In my opinion, Dane's delivery makes all 3 of these jokes funnier anyways, but they aren't similar enough to be considered ripped off or stolen. Stop making mountains out of mole-hill's, here. -
