- Midtowner, on 11/04/2009, -0/+1Actually, in bringing a claim for defamation, you don't have to prove that the claim was untrue. Truth is a defense, thus may only be raised by the defendant. Also, the defendant has the burden of proving the truth of his claim.
Further, it is not a defense for the defendant to simply claim they were repeating something they heard from someplace else. That's not even relevant. It doesn't even matter if the defendant's belief in the truth of what that third party (who should also be named as a defendant) was reasonable.

However, in THIS case -- she isn't repeating something someone said -- she is stating what happened to her. If saying "a McWilliams employe stabbed me" is defamation, when that employee stabbed you -- then we have a very, very screwed up justice system.
Of course it wouldn't surprise me; we can prosecute Courtney love for a Twitter comment but we can't Audit Hank Paulson after he misplaced $9 Trillion, or prosecute war profiteering.
