The husband would have to obtain consent to do anything with the tape as it is property of both spouses. If he does sell without consent, it leaves him open to being sued.
The point is that if he were to sell the tape, after a long court case, he would still keep some of the proceeds. Brittney, in this article, is out to make sure that he does not get a dime. There wasn't as much hype with Paris before the tape. Britney is largely successful because people have wanted to see this type of thing for many many years and they couldn't. There was the whole virginity thing. The whole kids role model thing. She has been built up so much.
Same thing with Sable from the (then WWF) WWE.
