The assailant traumatizes the victim the first time in the event and the second time in the trial.
Polanksi is ENTIRELY to blame for BOTH traumas, and society (and our proxy the prosecution) is to blame for NEITHER of them. Criminals MUST be prosecuted. The frustration this brings to the victim during the trial is NOT a second crime, it is the end of the first one.
