Im no whoopi fan, but when it comes to this story i think its unfair to align people with RAPE when they really aren't. The assailant traumatizes the victim the first time in the event and the second time in the trial.
Polanksi is ENTIRELY to blame for BOTH traumas, and society (and our proxy the prosecution) is to blame for NEITHER of them. Criminals MUST be prosecuted. The frustration this brings to the victim during the trial is NOT a second crime, it is the end of the first one.

That is a crime against the state, and they don't ignore rules of law or decency just because some moral failure feels that his personal entertainment is more important than anything else.
