If the porn industry makes substantially less than the film makers, then wouldn't they notice event he slightest loss of revenue due to piracy? Yes they would, yet they probably haven't or they would take measures to gain that back and curb pirates efforts to distribute their content free of charge.

As my sister says: "VHS won over Beta-Max because the porn industry used mostly VHS"

Porn proves that you can make a very good profit from creating content, without crying to the government every time someone makes a copy of your movie. If Hollywood can't manage on what they make, that's their problem, not mine or yours, or the governments. It could also be because they haven't got a very powerful organization with the economy to unite and back them up, such as the RIAA or MPAA. While porn is big business as well, I think it takes more organization than that to aggressively pursue pirates.

the mpaa and riaa are not the government, they are an organization that represents buisnesses. copyright infringement is illegal, but it is not necessarily criminal jurisdiction unless it is for commersial use (such as sale). therefore the riaa and mpaa have to bring individual violators to civil court, they face reparations and fines to these organizations, not jail time. - AlbinoRaven, on 10/12/2007, -0/+1@Optimaximal

DVD was the single strongest product launch EVER because the consumer base was practically slavering over its high quality and ease-of-use combination. It's not like music or main stream movies you'll go back to a hundred times. It's a shotgun approach where you give a ton of content and expect fast results and then a quick death. Why would a company care if a 10 year old video was being downloaded? At that point styles and preferences change and it becomes a nitch product. Sure, they want every penny, but if you watch Pron Teh Movie on some torrent site you just may go and get PTM 2 through 73.

First, the copyright owner has to find out about the violation and sue or make a complaint. If the copyright owner doesn't care then the government doesn't care either. Porn makes money on VOLUME. If they have a movie make a few hundred thousand dollars in sales, they are ecstatic. Because it is almost all profit. Even the biggest porn companies like Vivid. If they have a DVD that has $1 million is sales, they are dancing around the maypole.

Defendants would take their chances in front of a judge that could easily be against the very idea of pron to begin with, and therefore more likely to be less sympathetic. Plus, they also know that the defendant could drag out all the porn company's dirty laundry.
For example..imagine of Joe Francis tried to sue someone for downloaing Girls Gone Wild. Suddenly he would be forced to prove that all the girls were not only at least 18, but that none of them were drunk. Otherwise any contracts they sign to allow their footage to be in a video is invalid. Granted, like all the "reality" porn sites/videos, the girls who are actually doing more than flashing in the GGW videos are for the most part pair strippers/internet porn stars, so those would be fairly easy to prove.
