- Stepoo, on 01/09/2009, -7/+80This is the email I wrote to this dumbass. Feel free to send him the same email, a modified version of it, or a completely new email informing him of how much of a douche he really is.

Subject: To Dr. Biegel
You are a major douche. Stating your opinion is a protected constitutional right. Yelp makes it clear that the reviews contained within its site are just that -- reviews, opinions, and personal experiences. The negative review appears to me to be quite clear, especially in this context, that it's part of a personal review and one man's personal opinion -- and thus protected speech.
What I find hilarious about your situation is that by attempting to sue someone for expressing his opinion on an OPINION WEBSITE you have completely ruined YOUR OWN reputation. Before I read an article about the case, I had never even heard of Yelp. Now, this story is already making the rounds on news aggregating sites like Digg and Reddit. You, Dr. Biegel, dug your own grave by filing this ridiculously stupid lawsuit. If you hadn't been such a butt-hurt toolbag and just let the man express his opinion, I'm sure your business wouldn't have suffered that much. But now, everyone that reads one of the many articles on this case will think of you as the "greedy-*****-douchebag-doctor-who-can't-handle-someones-opinion-if-it-slightly-inconveniences-him".
Do the math in your head. 1 negative review is much less harmful to your business than a dozen news articles showing the world how much of a turd you really are.
It's too late for that now, Doc" - JazJon, on 01/08/2009, -1/+72What is the purpose of Yelp if you cant even post a negative review? This Dr Biegel Chiropractor guy is going to lose way more business now trying to sue than if he just let it go. Talk about a bad play. It's spreading all over now. Looks like a douche to me - inactive, on 01/09/2009, -0/+53Good luck with your lawsuit against another person's opinion.
Dummy. - Dumbledorito, on 01/09/2009, -0/+48You are SO sued.
- mwalker05, on 01/08/2009, -0/+47can i sue that guy on ebay for not giving me any feedback?
- ryeno, on 01/08/2009, -5/+49MDs don't like to be associated with the service industry or with outcomes...
- heybigjohn, on 01/09/2009, -1/+44He is not an MD. He is a chiropractor.
- inactive, on 01/09/2009, -1/+38The judge will sentence him to say, "A++++++++++++++ super gud ebayer!!!1!!1!".
- Chompy, on 01/09/2009, -5/+40He's not a real doctor anyway, he's a chiropractor.
- deweyhewson, on 01/09/2009, -2/+34A Chiropractor?
Funny, when I read "Doctor" I thought he was, ya know, a doctor, not a glorified masseuse. - twiztidsinz, on 01/09/2009, -1/+30The later would be LYING and considered Defamation of Character. Quite different than giving someone a negative review.
- MorganMghee, on 01/09/2009, -1/+30so, we're all headed over to yelp to add our opinion of the prestigious dr's lawsuit, right?
- cubicledrone, on 01/09/2009, -4/+32"Congress shall make no law... abridging the freedom of speech, or of the press"
Case dismissed. - Ne007, on 01/09/2009, -1/+26If the man did not post his entire name then the Doctor could be sued for breach of confidentiality since his lawsuit gives the man's identity and therefore links him to confidential information that was posted anonymously.
- cl2yp71c, on 01/09/2009, -2/+27The patient's site: http://www.standforspeech.com/
- Eorster, on 01/08/2009, -9/+33Funny, a Chiropractor at that. Chiropractors are akin to witch doctors. Just ask the doctor to scientifically prove they render any treatment that actually works, case closed. Chiropractors are snake oil salesmen of the 21st century.
- Dumbledorito, on 01/09/2009, -1/+24I don't get asked for feedback much. I usually post something positive, but leave a comment like "The item arrived intact. My dark lord is pleased with his offering. A+!"
- Eorster, on 01/08/2009, -0/+20Why yes, I believe you can. Couple hundred bucks and you can sue anyone. Now, whether the outcome will be fruitful, or the case even heard by a judge, is another story.
- algaeturd, on 01/09/2009, -0/+20He's trying to sue someone because he's balding perhaps. Wait. Can he sue me for saying he's balding? Not if it's true, I suppose.
- JazJon, on 01/08/2009, -1/+20It's on SFgate even: http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2 ...
- StigNordas, on 01/08/2009, -3/+21Welcome to the new world of transparency. Keep your sh*t tight and you won't have any issues.
- JazJon, on 01/08/2009, -1/+19Found another one: http://www.webpronews.com/topnews/2009/01/07/yelp- ...
- MiDNiGHTS, on 01/09/2009, -1/+18I hope this story gets big and the Doc loses more business than he could have imagined from 1 bad Yelp review.
- smeatish, on 01/09/2009, -0/+17http://www.yelp.com/biz/advanced-chiropractic-cent ...
And here is his yelp page... feel free to post anything you'd like as long as it's your OPINION - breakaway, on 01/09/2009, -5/+19Chiropractor? Urban witchdoctor.
- TheSabre, on 01/09/2009, -1/+15No, but if he gets sued in a court of law, which is the judicial branch of the government, then the government IS abridging his right to free speech. The Constitution says nothing of it being limited to "political" speech; I'm not sure where you got that idea.
- jlevine, on 01/09/2009, -2/+15Not one of you has posted anything positive about me in this thread. I'm suing all of you.
Please send me your mailing addresses. - cyrix, on 01/09/2009, -0/+13"I have never seen Dr. Biegel, but you can bet I would never see anyone who would sue someone where it concerns free speech. Shame on you."
HAH! That's ***** great. - dty2010, on 01/09/2009, -1/+14The review probably didn't hurt his reputation, but this could ruin it.
- inactive, on 01/09/2009, -0/+12This is the smartest PR move since that dollar store's insurance company refused to pay the family of that woman who was murdered while working at their store because it was a "only" a hate crime rather than a work accident. What in the world are these people thinking, that their potential customers aren't gonna notice grand-scale prickery in this modern age?
- inactive, on 01/09/2009, -0/+12I gave his website rating a "poor" on the bottom left side, I hope he doesn't sue.
- inactive, on 01/09/2009, -2/+13If only that were true. There's always some psycho who's mission in life is to consider themselves "violated" by everyone they do business with.
- AriaStar, on 01/09/2009, -0/+11Yeah, I know I can't wait to go see a doctor who will sue me for giving my opinion of his practices!! /s
- DubBucket, on 01/09/2009, -0/+10Good on ya. We should make an example of this turd.
- robwofter, on 01/09/2009, -0/+9It's not a freedom of speech case. The government isn't in anyway attempting to step on the man's freedom of speech.
This is a libel case. However, because the website clearly states that it is an opinion site the patient should win. - tristan55555, on 01/09/2009, -1/+10Maybe he's just mad because he's a "Dr." of chiropractory and not an actual doctor at all....
- joeanon, on 01/09/2009, -0/+9You are FREE to sue anyone for anything.
So it makes no sense to try to scare people by telling them behavior X could get you sued.
Just say, "dirty tactics used by corporations to deter free speech" or similar instead. - dyvvyd, on 01/09/2009, -1/+10So does crossing your fingers. Sometimes
- rdubbs, on 01/09/2009, -0/+9Agreed, better change that intro to "_I think_ you are a major douche," or better yet, "I think it might be a fact that you are a major douche"
- poidh, on 01/09/2009, -2/+10Wrong. If someone has a grudge against you, or has tried to blackmail you and failed, they can now leave a negative review to ***** you over.
- Gareth321, on 01/09/2009, -0/+8Someone post this on 4chan. There'll be a picture of his penis on the internet within an hour... plus his home address and someone would be tagging his letterbox as we speak.
- DirtyVicar, on 01/09/2009, -0/+8There damn sure need to be doctor & hospital review sites online, as there's plenty of ***** doctors out there.
- merreborn, on 01/09/2009, -0/+8I'm of the general opinion that beginning letters to doctors with the line "You are a major douche" tends to result in the writer being dismissed immediately as a child.
But maybe that's just me. - Murdats, on 01/09/2009, -1/+9massage does work, but why not just go to a massage practitioner or physiotherapist?
- JazJon, on 01/09/2009, -0/+7Looks like Yelp locked the review page after 6 one star reviews in a row. http://www.yelp.com/biz/advanced-chiropractic-cent ...
- inactive, on 01/09/2009, -4/+10Your wit and gumption are unparalleled, good sir.
- rabbitmo, on 01/09/2009, -0/+6or in Germany where it is common to take legal action for negative reviews. message board owners delete threads with negative reviews since they are afraid of getting in troubles.
- Locke23, on 01/09/2009, -1/+7"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."
No where does it mention it has to be political, and seeing it does mention "press" which in today's standards include the internet, the man is in all his rights.
There is nothing you can't say - to anyone.
If you take action on it or begin planning (conspiracy) then you might find other legal issues. -
