- phatguy471, on 07/26/2008, -0/+1If you would actually study that specific case instead of hearing of it from the distorted mass media, you would know that the liability of that incident was with McDonalds. McDonalds was at fault because they were storing the coffee at a much higher temperature than what it should of been stored at. Being that it was at such temperature, it caused a more severe injury than an injury at a lower temperature. Mcdonalds was penalized for 2 days of coffee sales. Which may seem like a lot but the lady's medical bills were in the hundreds of thousands of dollars.
I am not justifying this lawyers case to sue for that much. 5 million may be equal to the ticket sales not refunded, Who knows... There just isn't enough information in this article to determine whether this 5 million dollar case is frivolous or not.

I can understand why Delta would have a policy in place requiring certain changes be made at the ticket counter, but sometimes common sense and extenuating circumstances should override policy for the good of the customer.
What Delta did here is akin to refusing to refund a ticket after an earthquake or terrorist bomb destroyed the departing or destination airport, thus making the flight impossible. I think 5 million is a pretty ridiculous number, but when you're negotiating for payment you always start high and then dicker down till both sides agree. - Ninh, on 07/25/2008, -0/+1As a lawyer he can be expected to flap his arms and cross the atlantic under his own power.
