- bossm4n, on 10/10/2007, -3/+47Dear Lowes, it's not true...you know...what they say about any publicity being good publicity. Well this is bad publicity and shows how much you suck on several different levels. I'll remember this as I pass the driveway to your store next time I need something. Not that shopping at Home Depot is that much better, but since the two of you have managed to close down nearly every other independent hardware store in this country, what choice do we have? It's the evil of two lessers. Seriously though, your customer service is so crappy, it makes Best Buy look good.
- maz2331, on 10/10/2007, -0/+22Uh... I think you mean protected by the First Amendment. The Second is there to back up the First....
- theworldisflat, on 10/10/2007, -1/+23I had a situation with lowes before on my wifes grandfather's house. Their "subcontractors" totally screwed up the laying of carpet, it was horrible. Lowes ran a whole line of ***** on me, saying they aren't responsible for the contractor, yadda yadda. I simply asked them these questions:
1) From whom did I purchase the carpet? - Lowes
2) From whom did I seek out installation of said carpet? - Lowes
3) To whom did funds get issued for the material and the installation? - Lowes
Sorry lowes, the buck stopped at you. I could care less how you subcontract the work, as all of that is on the backend and transparent to me. I ended up calling Amex, who quickly put it into dispute and refunded the entire amount back to me 30 days later. I had the carpet repaired by a local shop, they were able to stretch it and re-lay it the correct way w/o needing much extra material.
Never use Lowes for anything but materials. - PurpZeY, on 10/10/2007, -1/+19Loews has absolutely no legal grounds in this case. Case law from almost every Federal jurisdiction holds that taking a domain name in order to subvert or steal someone's business for any kind of profit is illegal. However, creating a "gripe site" containing the name of the trademark or company is NOT by any means unlawful -- it is in fact protected by the Second Amendment of the Constitution. (see -- verizon-sucks.com, legal cite readily available -- 9th circuit).
- ayeroxor, on 10/10/2007, -0/+17Just look at all the crap corporations have tried to dish out, and EFF has blocked them every time!
Think they're worth a buck or two?! Help them out!
https://secure.eff.org/site/SPageServer?pagename=D ... - jacquesm, on 10/10/2007, -3/+18however if you threaten to sue while having the knowledge that case law exists that specifically rules that your lawsuit will be baseless that *is* abuse of the law.
- actorboy, on 10/10/2007, -6/+19Sending someone Cease & Desist letters is not abuse of the law -- because the sender has no authority to enforce the law. If I feel you are causing me harm, I have the right to ask you to stop. If you fail to comply, I have the right to ask for a legal ruling. If the court rules in your favor, I have to suck it up and go home. That's not abuse of the law, that's how the law is meant to work.
- uncertain, on 10/10/2007, -0/+11I like the idea of using the second amendment better.
- SeanNorton, on 10/10/2007, -2/+13I only wish I'd known of this site before, because complaining to Lowe's management doesn't help. I recently dropped over 3 grand on things for a bathroom renovation and the stuff was delivered late, the wrong sink was sent and it took about a month to rectify the situation since nobody in the place knew how to return a special order and get a new one. They offered to try to call and rush things and said they'd get back to me, but never called. I say not only is it legal, but they should embrace it and try to respond to the frank unfettered criticisms by making the stores better.
- wendeldiggs, on 10/10/2007, -0/+10If Lowes sucks they learned it from Home Depot... Grrrrr...
- hokie47, on 10/10/2007, -0/+9When will these idiot cooperations learn that they never win these public David vs Goliath battles. Every few weeks or so it is a similar story. I actually like shopping at Lowes. "A Lowe's "professional." is a independent contractor anyway, but Lowe's is still responsible to get the job done.
- trutek, on 10/10/2007, -2/+9What, do they hit you with sticks at Lowes, or what? I think that's what would be required to make Worst Buys customer service look good.
- uraliar, on 10/10/2007, -3/+9"Seriously though, your customer service is so crappy, it makes Best Buy look good." - Ha ha ha! That's funny.
- mjoshi, on 10/10/2007, -2/+8I had some horrible experiences with Lowes in past, most of time people working at store dont know what they are talking about (with few exceptions). Their customer service is almost non-existant.
- scorchedearth, on 10/10/2007, -2/+8This is yet another reason corporations need to have their status as a legal person taken away from them.
- cliffhanger407, on 10/10/2007, -0/+5um... wtf?
- TrevorBelmont, on 10/10/2007, -0/+5I would have gone with LowesBlows dot com.
- tizz66, on 10/10/2007, -0/+5Maybe that's what he meant...
- khedoros, on 07/31/2009, -0/+4I would qualify use of the law for baseless intimidation to be abuse, as is exploitation of ignorance.
- john2kx, on 10/10/2007, -0/+4After an experience like that, why use them at all?
- theworldisflat, on 10/10/2007, -0/+42nd amendment is the right to bear arms dude ;)
- Corgana, on 10/10/2007, -2/+6lowes-sucks.com redirects to Lowes.com for me..
- houndeyex, on 10/10/2007, -0/+4Wow, I totally wish that I knew about that site when I made this:
http://web.ics.purdue.edu/~jocull/images/blowes-te ... - Error601, on 10/10/2007, -0/+4There's usually two people with a clue at a Lowes or any of the big box home stores. The old plumbing guy and the old electrical guy. Forget asking anyone else a question.
- inactive, on 10/10/2007, -0/+3Best Buy sells Macs?
- MonsterChaOS, on 10/10/2007, -0/+3This is why I only buy at 84 lumber or busy beaver. Local businesses always have the upper hand when it comes to service.
- jlungu, on 10/10/2007, -0/+3wow. wish this guy had a petition to sign. i stopped shopping @ Lowe's a couple years ago after a horrible customer service experience ... go man go!
- themulf, on 10/10/2007, -3/+6The guys at 2600 set a rather interesting precedence for such a legal case, http://www.fordreallysucks.com/more_info.html.
- Murdats, on 10/10/2007, -1/+4no, just intimidation and gambling on their ignorance.
- dmoney22, on 10/10/2007, -0/+2I want bear arms.
- zenzic64, on 10/10/2007, -1/+3Wow, are you a troll, a lawyer, or just utterly clueless? I'm guessing all three. How has our society sunk so low that we think the first recourse in any situation is to threaten legal action, even if our case is completely devoid of merit. And how can we possibly view the bullying actions of a corporate giant who knows they are in the wrong as anything other than the shameless act that it is. They do it because it works. Most people are too afraid of the costs of defending themselves, even if they are in the right, to stand up to a fleet of lawyers. So they quietly comply and the bully goes on to the next wimp to kick sand in his face. But to say that they should "...err on the side of sending a letter." is to tacitly approve of the litigious nature of our society and the loss of individual freedoms we've all experienced as a result.
- Nougat, on 10/10/2007, -1/+3I'm with you on that one, but that's not just Lowes. Menard's, Home Depot do it, too. It's a way for the corporations to get more revenue without having to put long-term investments into anything - hire subcontractors. I've always been wary of using local subcontractors through a big box home improvement store, but we did get a couple of things through Home Depot a while back. Carpet and laminate. Each was handled by a different subcontractor. The laminate was fabulous, the guys working the job were great. The carpet was sloppy, they brought the wrong padding (which was the fault of the sales person at Home Depot, actually).
Since you don't get to vet the subcontractor ahead of time by actually speaking with anyone who will be executing the project, it's a crapshoot. Is it bad behavior by Lowes? Yes, but it's bad behavior by *everyone,* which consumers should be aware of. - mzwaterski, on 10/10/2007, -1/+3Did you agree to have the duty of installing the carpet assigned to the subcontractor? If so, see novation: http://en.wikipedia.org/wiki/Novation
- scrimaxinc, on 10/10/2007, -1/+3I tried to go to lowes-sucks.com and I was routed to the actual Lowes store page. I guess he did end up hearing from them after all?
- Deguello, on 10/10/2007, -0/+2$3000 is generally out of the purview of most small claims courts.
- davotoula, on 10/10/2007, -0/+2no it doesn't
- insomniac8400, on 10/10/2007, -1/+3You can't send out baseless letters that quote law in an incorrect way to trick someone into listening to you. Otherwise, yes, you could send a letter plainly asking someone to take a web page down because you don't like it.
- coolusername, on 10/10/2007, -1/+3Hey, i tried to go to lowes-sucks.com but it redirected me to lowes.com. Anybody else see this?
- thomn8r, on 10/10/2007, -0/+2Actually, you would end up in small claims court, where (at least in CA) you *can't* have an attorney represent you, but the defendant (Lowes) *can*, because they're a corporation.
- uncertain, on 10/10/2007, -0/+2Want to take a guess how much EFF has spent so far on this? Researching the law, writing responses to Lowes, negotiating some sort of a settlement. I bet two grand won't touch what they spend on this case.
- liminaldust, on 10/10/2007, -1/+2I don't agree. In my book, it is called abuse.
1. it wastes the defender's time
2. it wastes everybody's tax dollars going into the legal system
3. it attempts to take advantage of the fact that someone in general public might be unaware of his rights
I would hate to have legal action taken against me because of all the time, effort and energy it will require on my side. While it may eventually cost the abuser more money, they probably have their lawyers sitting around with nothing better to do anyway.... There's certainly people who would take down the site rather than to deal with all the nonsense. - Nickdotnet, on 10/10/2007, -1/+2Dugg for screwing over corporate America. Kill Capitalism!
- postalblowfish7, on 10/10/2007, -0/+1corporations-suck.com
- Lathen, on 10/10/2007, -0/+1I work as a cashier in a fairly new Lowe's store (approx. 1 year old). I keep hearing these horror stories about Lowe's and I'm not sure if the amount of time the store has been open changes things. At my store, things like this wouldn't happen. All of the management are anal about helping customers and regularly bend corporate rules to help people out (giving a cash refund for a check on the same day because a customer was broke, they usually have to wait 15 days for the check to clear). What I have seen happen though, is that a lot of the really nice people get transferred out and the people who started as cashiers (and generally don't give a *****) slowly move up the ranks.
At least they pay well... - uncertain, on 10/10/2007, -0/+1$1500 in Ohio.
- inactive, on 10/10/2007, -1/+2Well, if you don't know anything about PCs, maybe a MAC is better for you.
- AdamFromMyspace, on 10/10/2007, -0/+1Broken link.
- inactive, on 10/10/2007, -0/+1Clear Channel tried this crap and we were heading to legal proceedings prior to going to mediation and Clear Channel giving up due to my willingness to head to court and not backing down from their threat to charge me pretty much every penny I'd ever made to pay back their lawyer fees...
