- scott1, on 10/12/2007, -13/+70Can Illegal immirgrants file a lawsuit for somthing they did illegeally?
- keyboardashtray, on 10/12/2007, -2/+54That was my first reaction too, "How can they sue?!"
But the immigrants were getting money deducted from their checks to cover legal expenses. That changes a lot.
Still ultimately shows plenty of blame to be spread around, the immigrants still came illegally, the government still didn't stop them from getting in, Wendy's still hired them, and the government still lets companies hire illegals.

It's America! You can file a lawsuit for anything you want. - elnerdo, on 10/12/2007, -12/+28If you're illegal, you shouldn't have ANY RIGHTS AT ALL save for international rights (such as the right to not be tortured).
- AriaStar, on 10/12/2007, -4/+19What is not clear is if they were illegal at the time of their hiring. If they were here on work visas, then they were legal at time of hiring, and became illegal at the time the deadline passed, not at the time of discovery. If they were illegal when hired, that's a different story.
Thsi article mentions their illegal status only post-paperwork-failure. This was to help them gain legal citizenship, yet you can be legally in this country without citizenship if you have the proper documents and clearance.
Also, you don't have to be an American citizen to sue an American/American company in America. There are no laws saying you can only sue people in your own home country. If there were, we never would have had the bit of humor known as Apple v. Apple. - betterth, on 10/12/2007, -6/+21I don't understand why you're digging red4golf down -- He has a point. The term illegal immigration has become a hot term these days, but let's not forget what it comes from. Illegality. From the second they entered our country, knowingly illegally, they were criminals.
I have absolutely no issue whatsoever with hardworking people entering our country and entering our workforce.
But I have an issue with people doing it illegally and skipping out on income tax, on medicare, on social security.
Get legal or get out -- respect the laws of the country if you want the country to respect you. Am I asking for too much? - bbatsell, on 10/12/2007, -3/+16Did you bother actually reading the article? They _were_ trying, and they were paying legal expenses with every paycheck in order to obtain legal status. The company in question took the money and didn't perform the services required in order to obtain legal status.
- red4golf, on 10/12/2007, -19/+31Too bad for you, should have been legal in the first place.
- radarx, on 10/12/2007, -6/+17I hope they advertise on telemundo about this, and say it is going to be a class action suit, and all illegal immigrants can show up on a tuesday morning @ 9 a.m. to sign up and get paid. Whoever shows up, deport them. Anyone working won't be there, and those people can stay. I have no problem with people coming to this country and working and paying taxes. That's what made this country what it is. However, if you come across the border illegally, have 12 children, refuse to work, make everyone bow to you and speak your language, get on welfare and put the utility bills in the children's names so they don't have to pay....get the ***** out of my country.
Welfare is a decent program for those short times in everyone's life when they need to get their ***** together. I've been on it during those short months between bad jobs and before moving to another location where jobs that pay real money are available. That's exactly what these immigrants are doing...moving to a better place. Go through the process right...that's all I'm saying. - inactive, on 10/12/2007, -6/+16It is my understanding that you cannot contract for an illegal activity. Therefore, you can't sue when the other party breeches that contract, as there never actually was a contract in the first place.
- mykodacon, on 10/12/2007, -11/+20I am so sick and tired of the god damned illegal immigrants. They should not be allowed to sue at all. Unless they are willing to pay all the costs up front out of pocket. Why the hell should I front the bill for them. I am sick of this *****. This is EXACTLY what it is... *****. They take our jobs but they don't pay taxes. Some of them illegally file for false social security and they get it. It is taken away from those of us who have earned it. If I claimed to be an illegal, I would get better medical care than if I claimed I was a citizen without insurance? WTF is going on damnit? Dog the Bounty Hunter is going to be extradited for apprehending an American fugitive GUILTY of rape but the ***** mexican government will not return an American cop killer to us? I am getting entirely PISSED over this whole issue. ILLEGAL IMMIGRANTS ARE STEALING FROM US!!! I don't pay my taxes so that way some damned illegal who takes the money into another county can prosper. I don't care about the living conditions. I care about my family, myself, and the WORK I PUT INTO MY OWN SOCIAL SECURITY!!! I want the fence built, I want Escondido to enact the landlord fine for housing illegal immigrants, and I want them to get the HELL OUT OF MY COUNTRY or PAY SOME TAXES!!! I don't pay for anyone other than those I choose to you theiving bastards. I am sick of you, your children, and I am sick and tired that America caters to you. If you are going to come to this county, LEARN ENGLISH, BECOME AN AMERICAN, AND SUPPORT AMERICA!!!!
- publicXuse, on 10/12/2007, -3/+13Funny Last time I heard that it was followed with "Go back to Africa".
- WilkieJC, on 10/12/2007, -13/+22If you're illegally in the country, you shouldn't have the right to bring such a lawsuit. I'd hope they'd get the message and do what they can to get legal status the right way.
- mwebb1984, on 10/12/2007, -1/+9"Attorneys for Olivares said the company deducted $25 from his weekly paycheck of $313.20 for 4 1/2 years to cover legal fees associated with the program. With the rest of his paycheck, Olivares said he helped support his sister, her two daughters and his ill mother in Mexico City" --- And we wonder why our economy is having so many problems??? So much of the money that's supposed to be going back into US consumer's pockets so that they can in turn buy from US companies that will pay their employees, etc. (cycle), is being funnelled into Mexico by illegal ALIENS. They're not immigrants, the term is ALIEN because they're Mexican citizens not US citizens and have NO legal right to be here.
Illegal aliens actually cost much much more to the overall US economy because although the nominal wages are generally lower, much more of the money Leaves the US economy than would if you paid a US worker more money to do the same job. - matthewhemby, on 10/12/2007, -4/+12RTFA, idiot. Cafe Express was taking money out of their checks every pay period to provide this legal service, even after the deadline for application had far passed.
- reddevil3, on 10/12/2007, -1/+8I am a foreign citizen studying in the US right now. While racism is very much alive in the US, I have seen a lot of Mexicans who speak little English and probably live illegally here. It's an insult to people like me who come here legally...it's extremely difficult to get a US visa, especially in the post 9/11 world.
I learned English before I came here and I speak it pretty well. People turn against the Mexicans because they refuse to speak/learn English, demand rights when they don't deserve them and call people racists for no reason. They also wave the Mexican flag inside the US...they should be glad that people in the US can tolerate this *****...if you wave a foreign country's flag in any country the people will beat you up in a second.
Of course not all Mexicans are like this. I know a Mexican family in my apartment complex who speak English well and are probably here legally, although I do wish they wore a shirt most of the times.
*edit*: Meant to reply to 'Parasocks'...damn comment system! - inactive, on 10/12/2007, -3/+9Okay... FTA:
"Between the two lawsuits, 40 illegal immigrants say they were fired after the company recently found that Boyar & Miller, the law firm Wendy's had hired, never filed paperwork for a 2001 legalization program that allowed immigrants with employer sponsorship or an American spouse to apply for citizenship.
Once the discovery was made, Wendy's was forced by law to fire the employees because of their illegal status. Immigrants in the program would have been insulated from being fired."
Okay, I don't understand the suit against Wendy's because they were just doing what they had to do as per the law. It was Boyar & Miller that screwed the pooch on this one. These people were TRYING to become legal citizens and the law firm dropped the ball. Not only did they drop the ball, but they took these people's money to perform a service and did not follow through.
I, for one, hope the win the suit against Boyar & Miller. On the Wendy's thing: Wendy's needs to step up to the plate, get the money back from the law firm and get these people into the legalization program like they were supposed to do. - Spyntek, on 10/12/2007, -1/+7They don't pay taxes. And please don't buy into the argument that they obtain a federal ID# and willingly pay into the system. This is a complete fallacy. Most illegal immigrant money goes back to the country of origin, in this case it is Mexico. Vincente Fox pushes for illegals to come to this country because remittances back to Mexico are the single biggest source of revenue for Mexico, even out pacing oil exports!!!!
One thing that I haven't seen mentioned here is the fact that a slight majority of illegals use stolen social security numbers. One woman in California had her number stolen and was used by over 200 illegals, totally ruining her credit, and the woman you heard about who is holed up in that church in Chicago, she is being deported because it was discovered that she too obtained employment using a stolen social security number.
Listen we don't have to deport them. Start fining employers heavily for each illegal they hire, fine landlords who rent to and real estate agents who sell houses to illegals. Yes, illegals have been able to obtain mortgages!!!, fine banks who let them open accounts, remove the lure of free healthcare, free social services, education and in-state tuition at colleges and this notion that if you come across the border to have a baby, your baby is automatically a citizen, anchor babies. If you remove all of these lures, then something will happen. It is called attrition. They will simply leave. Then our tax dollars can be used for better things - Cam_86, on 10/12/2007, -3/+8This is like suing someone for seeling you oregano instead of marijuana.. Who cares if you got screwed out of a ounce of pot, the fact that you were trying to buy it is a bigger issue.
- conwayblue, on 10/12/2007, -8/+13I wish I was an illegal immigrant. No taxes. Free healthcare.
- Spyntek, on 10/12/2007, -1/+6Thank you. Someone who understands. You are correct in your assessment of those who come from Mexico. A large majority of those who come here illegally don't assimilate into the American society, many go their whole lives without learning much english.
If you are going to come to America to live, then learn the language and adopt our culture as your own. You don't have to give up your own culture but realize that we will not kowtow to yours!!!
Thank you for your honesty. We want immigrants such as yourself and we as Americans would welcome you - Araya213, on 10/12/2007, -3/+8I have a quick solution: Deport these *****.
- inactive, on 10/12/2007, -0/+4What I don't understand is why can't they find work in Mexico? Mexico has the 13th largest economy in the world according to nominal GDP. Mexico is not some poor backwards *****. They have a modern manufacturing and agricultural industry with decent infrastructure.
- superwawi, on 10/12/2007, -5/+8Good lawsuit. He was paying legal fees to obtain citizenship. Case closed, next subject please.
- inactive, on 10/12/2007, -2/+6***** the Bush administration. He decided to go to Iraq for no reason when we have an enemy right in our own backyard. Mexico is invading the US and we aren't doing a god damn thing about it.
- KanosWRX, on 10/12/2007, -7/+11They should use this as an opportunity to gather all the illegals up trying to sue and send them back. Don't take up time in our legal system don't waste my money.
- TheWino, on 10/12/2007, -3/+7WOW
I started reading everyone scomments and got about 10 down and no one was commenting on the news article!!!! people just bantering on how "Illegals" are taking everything from the "Hard" working americans! FFS read the damn story before commenting!!!!
They should sue because for 4 1/2 yrs monies were being taking from their check to pay for legal services to become legal!!! I want to see u pay for something for 4 years and at the end they say "oh im sorry there was nothing really going on" Will u jsut sit there and do nothing? oh wait we have done that *cough* Iraq *cough* - Odweaver, on 10/12/2007, -1/+5"Second."
Simple, they cost the company less, a legal worker gets around 5.50, an illegal costs less than half that, so why hire the legal one?
"Third."
Until I start seeing canadians, asians, or Europeans lowering the American flag on government buildings and raising thier own or marching in the streets waving the flag of the country they came from, I will focus on the biggest pain the ass.
"Fourth."
Godwinned, instafail
"Fifth:"
They already comitted the crime, any promise of being leiniet is generosity.
"Sixth."
Ah, didn't realise that the American dream meant being a vent for other countries problems.
"SEVENTH."
It was partially mine in the first place, i'm Cherokee and I've had my SSN stolen by an illegal before I was fifteen. - mstar, on 10/12/2007, -4/+8I wouldn't call it free healthcare (I would call it ***** healthcare). In fact illegal immigrants are less likely to use healthcare then most. They all pay more in taxes overall then what gets spent on them even if you count education, "healthcare", and eveything else.
- ejm508, on 10/12/2007, -5/+9If they care so much, they can become citizens
- InetRoadkill, on 10/12/2007, -4/+8If I were on the jury, I'd award them $1.00 and a free bus ticket back to the border.
If you want to stop illegal immigration, then stop rewarding it. - inactive, on 10/12/2007, -9/+13"There's an American, let's take his job!!!"
*lolzcopter - heyitsme23, on 10/12/2007, -5/+8Slacker teenagers need those jobs, because thats where they learn good work ethics. When illegals hold all those job positions, it makes it harder for a US citizen to get work at those jobs. Also, it keeps minimum wage low, because their willing to work for anything.
- trunkster, on 10/12/2007, -0/+3In Washington State you can fire people for any reason you want. Great job security.
- CiXeL, on 10/12/2007, -2/+5@ mykodacon
amen brother. you want to see some real f-ed up stuff? come to miami (not miami beach) and see where southern california is going to be in 20 years.
widespread corruption. apathetic police. people driving without license plates. extreme nepotism and apathy in workplaces. i work here and see the americans busting their asses while the latin coworkers sleep on the job or slack off. i can go to the US post office by my work and noone knows english. they have to call a translator over the phone when you come in. theres a reason theres a United States (espanol) on the fedex website now. i moved here from southern california and ill probably be moving somewhere else soon because with a culture and work ethic like this companies are certainly going to leave. there seems to be a culture of exploitation down here where the general attitude is "***** america, steal whatever you can". i see lots of people driving luxury cars with handicapped plackards. people driving luxury cars like race cars with near misses all over the turnpike. it seems everyone bought their houses here on interest only loans too. complete financial irresponsibility and zero accountability. its a mad house here. i'm hoping to God i can move away before i get killed in a car accident. where i work in hialeah the city has even stopped painting lane lines on the street. let me ask you, how can you tell who is at fault in an accident if there are no lane markers on the street? - tuna1, on 10/12/2007, -5/+8Use spellcheck and stay on your meds.
- publicXuse, on 10/12/2007, -3/+6That is an ignorant statement like the ones that say illegal immigrants are all criminals.
- CiXeL, on 10/12/2007, -0/+3@ DumbCommonHerd
exactly. labor shortages are the product of a healthy economy. all it means is companies will have to raise wages to steal a skilled person from another company. by using illegal immigration and visas companies can devalue the wages they have to pay a person in a skilled position to almost nothing. - inactive, on 10/12/2007, -2/+5Illegals or retarded teenagers...doesn't matter. Your order is likely to be muffed no matter what.
- heyitsme23, on 10/12/2007, -6/+9then youve never ate fast food in Colorado (when they don't speak english, you don't get what you want, and its usually burnt)
- conwayblue, on 10/12/2007, -1/+4If I ony had to pay taxes on my purchases and not income and state taxes like these illegal ***** I would be a happy camper
- forcedfx, on 10/12/2007, -1/+4What does it being a hoax have anything to do with teckjunkie's statement?
- Rickler, on 10/12/2007, -1/+4To late, they're here; 30 million of them. And over half the births in america are from first or second gen illegals. Viva la Aztlan!
http://www.youtube.com/watch?v=STGYN3vyEj8 - inactive, on 10/12/2007, -4/+7They got into our country illegally, any of their work is illegal. Go back to your own country, work there, get the money to become legitimate and file from there. It is ***** that you cannot earn money in Mexico. I work for a Mexican, he lives in Mexico, he makes triple what I make.
- inactive, on 10/12/2007, -3/+6I enjoy how your post was modded down even though it was the 100% truth :)
Goes to show the ignorant groupthink that is digg. Uneducated morons. - pixelpimp, on 10/12/2007, -1/+4What the Hell is happening in this Country?
- NinjAlt, on 10/12/2007, -2/+5How does one pay taxes without a social security number? How can all these people claim they pay taxes if there is no way to track them?
- NinjAlt, on 10/12/2007, -5/+8@stylerm
I didnt see race mentioned at all. Why bring up a race card? Thats just a ploy to avoid the fact that they broke the laws of this country and got burned when laws didnt protect them. You cant have it both ways.
Also, illegal immigrants can be ANYONE. If you pull a race card then YOU are the racist. - publicXuse, on 10/12/2007, -1/+4Free healthcare? Funny last time I was taken to the ER after an accident I got an bill for an X-Ray I got. Where is my free healthcare?
- ranjur, on 10/12/2007, -1/+3Amen mykodacon. Get involved. I'm sure there is an immigration reform organization in your area. They've sprung up in most states across the country. Just go to fairus.org, and I believe they have a list of organizations by state. You'll feel better if you participate a bit.
