Illegal Immigrants Sue Wendy's

npr.org — A group of illegal immigrants who worked for Wendy's International Inc. is suing the restaurant chain because the company fired them after discovering it had missed a deadline for joining a federal program that would have helped them attain legal status. The immigrants, who worked for Cafe Express, are seeking unspecified damages.

      But the immigrants were getting money deducted from their checks to cover legal expenses. That changes a lot.

      Still ultimately shows plenty of blame to be spread around, the immigrants still came illegally, the government still didn't stop them from getting in, Wendy's still hired them, and the government still lets companies hire illegals.

If they were here on work visas, then they were legal at time of hiring, and became illegal at the time the deadline passed, not at the time of discovery. If they were illegal when hired, that's a different story.

      Thsi article mentions their illegal status only post-paperwork-failure. This was to help them gain legal citizenship, yet you can be legally in this country without citizenship if you have the proper documents and clearance.

      Also, you don't have to be an American citizen to sue an American/American company in America. There are no laws saying you can only sue people in your own home country. If there were, we never would have had the bit of humor known as Apple v. Apple.

      If they came here on work visas and were hired under those visas...then became illegal by not entering the program or letting their visas lapse, Wendy's was completely in the right to fire them.

      It was the smart thing to do on their part, especially in the light of the "it's not the illegals fault, let's leave them alone punish the companies that hire them" attitude that's prevalent nowdays.

      Okay, I don't understand the suit against Wendy's because they were just doing what they had to do as per the law. It was Boyar & Miller that screwed the pooch on this one. These people were TRYING to become legal citizens and the law firm dropped the ball. Not only did they drop the ball, but they took these people's money to perform a service and did not follow through.

      I, for one, hope the win the suit against Boyar & Miller. On the Wendy's thing: Wendy's needs to step up to the plate, get the money back from the law firm and get these people into the legalization program like they were supposed to do.

      But I have an issue with people doing it illegally and skipping out on income tax, on medicare, on social security.

They were also the ONLY ones paying taxes on what they earned (you can get a Tax Payer ID from the IRS which sort of acts like a SS number). Go figure...

      Yes because it's easier to spend all the cash and assets you have in order to pay some guy to guide you across the freaking dessert than to get a work visa. Why is it that people seems to throw common sense out the window regarding issues like this?

      This point I keep hearing about how people don't mind hard working people coming here legally because it's so easy just gets me ticked off. IF IT WERE THAT EASY TO COME HERE LEGALLY DON'T YOU THINK THEY WOULD DO IT INSTEAD OF RISKING THEIR LIVES CROSSING THE BORDER ILLEGALLY?

      Not everyone is in the same situation as you and not everyone has the priviledge to get a visa to come here, much less a work one. Be glad your family had the means and opportunity to come here legally instead of risking their lives sneaking in. It is so easy to bash immigrants when you're not one or the only thing that separates you from being an illegal one is a piece of paper.

      Oh and about HALF of the 12 million illegal immigrants in this country came in legally with a visa they just weren't able to renew it or become citizens. I guess they just forgot to renew their visas, I mean all you have to do is go to INS and have the nice clerk stamp your visa for another year right?

That's what made this country what it is. However, if you come across the border illegally, have 12 children, refuse to work, make everyone bow to you and speak your language, get on welfare and put the utility bills in the children's names so they don't have to pay....get the ***** out of my country.

    Welfare is a decent program for those short times in everyone's life when they need to get their ***** together. I've been on it during those short months between bad jobs and before moving to another location where jobs that pay real money are available. That's exactly what these immigrants are doing...moving to a better place. Go through the process right...that's all I'm saying.

      widespread corruption. apathetic police. people driving without license plates. extreme nepotism and apathy in workplaces. i work here and see the americans busting their asses while the latin coworkers sleep on the job or slack off. i can go to the US post office by my work and noone knows english. they have to call a translator over the phone when you come in. theres a reason theres a United States (espanol) on the fedex website now. i moved here from southern california and ill probably be moving somewhere else soon because with a culture and work ethic like this companies are certainly going to leave. there seems to be a culture of exploitation down here where the general attitude is "***** america, steal whatever you can". i see lots of people driving luxury cars with handicapped plackards. people driving luxury cars like race cars with near misses all over the turnpike. it seems everyone bought their houses here on interest only loans too. complete financial irresponsibility and zero accountability. its a mad house here. i'm hoping to God i can move away before i get killed in a car accident. where i work in hialeah the city has even stopped painting lane lines on the street. let me ask you, how can you tell who is at fault in an accident if there are no lane markers on the street?

      I think what you're referring is FREE EMERGENCY CARE. I highly doubt that any doctor or clinic will give service to an illegal immigrant without charging them.
      If what you say is true, why don't you got to a doctor or clinic and to get a physical say you're an illegal immigrant and see if they charge you for the consultation.

    If you cannot find an American to do a job for minimum wage, guess what? Raise the wages, maybe to something like a livable wage. THEN maybe you could get good workers.

    This is why wages for so many blue collar workers in the US are not keeping pace with inflation. Why pay decent wages and benefits when you can take advantage of this cheap disposable mexican labor.

    Meanwhile the top 5% of Americans have 90% of the wealth. Just about time for a revolution.

They were working and paying their taxes and trying to gain citizenship legitmately through this program. If Wendy's was deducting money from their paychecks, they have legal right to seek redress. This is a bad example for the vast majority of illegals that come here, have a kid, or hide in the depths of bearacracy collecting government aide and health care. I really have no problem with immigrants but when there illegal and plan on staying liek that but enjoying American aide programs and benefits thats when I say deport time.

Most illegal immigrant money goes back to the country of origin, in this case it is Mexico. Vincente Fox pushes for illegals to come to this country because remittances back to Mexico are the single biggest source of revenue for Mexico, even out pacing oil exports!!!!

      One thing that I haven't seen mentioned here is the fact that a slight majority of illegals use stolen social security numbers. One woman in California had her number stolen and was used by over 200 illegals, totally ruining her credit, and the woman you heard about who is holed up in that church in Chicago, she is being deported because it was discovered that she too obtained employment using a stolen social security number.

      Listen we don't have to deport them. Start fining employers heavily for each illegal they hire, fine landlords who rent to and real estate agents who sell houses to illegals. Yes, illegals have been able to obtain mortgages!!!, fine banks who let them open accounts, remove the lure of free healthcare, free social services, education and in-state tuition at colleges and this notion that if you come across the border to have a baby, your baby is automatically a citizen, anchor babies. If you remove all of these lures, then something will happen. It is called attrition. They will simply leave. Then our tax dollars can be used for better things

The US subsizes corn growing here and turn up so much of it that they drive the price of it. The Mexican farmer ends up without a job because he couldn't compete. Same thing with meat. And the mexican politcians who could do something about it won't because they're all in the pocket of some big US corporation. The current president of Mexico is a Shill for COCA COLA. Do you honestly think that it is in the best interest of those companies to have a Mexico or any other South American country where the people are not exploited?
      In order for us to get cheap ***** at walmart someone has to be exploited.
      Can you really feel so much anymosity for someone who will try to escape from such dire circumstances, going so far as to risk their lives. What would you do in their place?

      Come down to California (Northern or Southern), New Mexico, Arizona, Las Vegas (Nevada), Texas. Spend some time there and figure out why the American people are pissed off, the situation is so out of control it's hard to describe.

      It's also hard to describe how frustrating it is when your government will not do a damn thing about it, they know we're sick and tired of the current situation, yet nothing is being done. We need to let our government know they will be out of a job real soon if something doesn't change.

      I feel for the Mexican and Latin American people, their country has failed them, their system is corrupt, we offer a way for them to get out of that system. The problem is we can't absorb them all, and they don't want to be absorbed. We're seeing crime rates increase, and diseases we thought had been eradicated from our country years ago. They really need to fix their situation at home and not bring the problems up here.

While racism is very much alive in the US, I have seen a lot of Mexicans who speak little English and probably live illegally here. It's an insult to people like me who come here legally...it's extremely difficult to get a US visa, especially in the post 9/11 world.

    I learned English before I came here and I speak it pretty well. People turn against the Mexicans because they refuse to speak/learn English, demand rights when they don't deserve them and call people racists for no reason. They also wave the Mexican flag inside the US...they should be glad that people in the US can tolerate this *****...if you wave a foreign country's flag in any country the people will beat you up in a second.

    Of course not all Mexicans are like this. I know a Mexican family in my apartment complex who speak English well and are probably here legally, although I do wish they wore a shirt most of the times.

      If you are going to come to America to live, then learn the language and adopt our culture as your own. You don't have to give up your own culture but realize that we will not kowtow to yours!!!
