(1) He may never have been exposed the industry, suppliers and distributor networks without having worked at Mattel.
(2) Any research information or other company resources would aid development which he normally wouldn't have access to.
If it's safe to assume he may never have developed them unless he worked at Mattel, and did so during his time at Mattel, then there's a case.

In this case, the manufacturer of the Bratz dolls was found to have violated the laws about developing a product while working for someone else by a JURY, not a judge. The judge simply gave the appropriate orders.
Frankly, I think it is *****. It would be one thing if he stole secrets from Barbie, but AFAIK, he didn't. "oh, little plastic dolls. What a good idea." If he can improve on the idea, good for him.
