It sounds like the Basketball Hall of Fame licensed its name out exclusively to SportsFuzion, and then reneged on the deal by licensing it again to Nike. This is clearly against the contract with the former, and the Basketball Hall of Fame should be liable, and possibly Nike, if they willfully or knowingly made the Basketball Hall of Fame breach contract with SportsFuzion. And the lawsuit is directed at those two companies, not frivolously at subsidiaries and the likes. And they aren't waiting so that they can squeeze more money out of them, they're truly acting to protect their business interests.

Not one of those stupid patent or trademark lawsuits. They have a legitimate business and drew up a legitimate contract with the NBA HOF.

I assume that Sportfuzion attempted to come to an agreement with Nike, but they said no go, and Sportfuzion is suing.

Nike is creating an "Air Jordan Hall of Fame" Collection. (Note: They are not using the same name as "Basketball Hall of Fame")
SportsFuzion does NOT have the rights to the shorter more inclusive "Hall of Fame" name. But they seem to be linking "Air Jordan" to mean "Basketball".
As long as Nike doesn't add "Basketball" to their "Air Jordan Hall of Fame" then SportsFuzion will not win this case.
Jordan does not have an exclusive contract with the Hall of Fame nor does he have one with the NBA anymore. Nike doesn't need to get anyones approval for what they wish to make for their Air Jordan line... only the wording they use. - jts10, on 06/24/2009, -1/+2the NBA can NOT give exclusive rights to the "Hall of Fame", nor can they give them to the "Basketball Hall of Fame".
The NBA has no rights over any basketball played outside of the NBA. College, Foreign, Olympics, etc...
Jordan & Nike can use his own name to create what ever he wants. They may not use "Chicago Bulls" without the NBA's consent, and the NBA can't give it to them for these products because they sold that to SportsFuzion. It really depends on the products they are making that determine if this is a case or not. Basketball Hall of Fame ≠ Air Jordan Hall of Fame Collection
SportsFuzion has marketing rights over "Basketball Hall of Fame" and the NBA Teams (as a team only). They have no rights over the individual players. As long as the Air Jordan Collection does not use "NBA" or "Chicago Bulls" in any of its products, they are in the clear.

- dolemite01, on 06/24/2009, -6/+1Not sure how this is breaking news etc, if you read the article SportsFuzion has owned the trademarks of the NBA's Hall of Fame since around 2006, since then Nike has used a trademark now owned by SportsFuzion in an attempt to sell Air Jordan HOF editions. It's not as if Jordan has some how woke up and realized Nike was using his name all these years and is now suing. Furthermore regardless of who owns the trademark and sells them legally no doubt a few people will overpay for the shoes and some kids will get shot while theirs are stolen.
