Here's how it works:
1. Video company doesn't want on the internet makes it to the internet.
2. Company freaks out.
3. Freakout draws lots of attention, creating free advertising or hilarious criticism... good or bad publicity either way.

The video itself is clever, but I can see the position it puts JC Penney in if they never approved of releasing the ad.
