Shame what slapping an Apple with a piece bitten out of it on a phone can do to an entire culture. - SteveMax, on 10/28/2009, -0/+7You keep repeating that 15% figure, but AFAIK Nokia's claim is for 1% to 2% of each phone's cost. Also notice that every other company out there pays a similar value, either directly or indirectly as other patent licenses. Apple possibly has been infringing on Siemens's or Qualcomm's patents too, since those three have developed almost every technique currently usable for developing a GSM/3G phone. Nokia settled a suit with Qualcomm recently, which would also run in the billions of dollars.
The point is that if you develop the technology, you deserve to be able to use it or to sell other companies the right to use that technology in order to cover your R&D costs. - blackinthmiddle, on 10/28/2009, -1/+5Wow, give all the blame to Apple, eh? Last time I checked, Apple initially went to Verizon and was rejected. When they went to AT&T, it was AT&T that said they'd only agree to Apple's terms if they were the exclusive carrier.
The only good thing about an exclusive deal with AT&T for Apple is that if their phone were offered to all carriers, that would in essence cannibalize their iPod Touch market as there would truly be no reason to carry around a cell phone and an iPod Touch. However, my bet is that their lost iPod Touch sales would be more than made up for in additional iPhone sales. - rpgmakr, on 10/28/2009, -0/+4What? The reason Nokia has not done well (recently) in the U.S. is because it has refused to form exclusive alliances with carriers, locking out competition, like Apple has. It's time to give the power back to consumers.

Apple is playing by US carrier rules and retains a surprising amount of control over its device. You need only have to look at Verizon as the most egregious violator of device micro-management.

No, they are the largest phone manufacturer in the world with the most popular smartphone OS. Was SCO the largest UNIX vendor at the time of its lawsuits? Agreed. I've never had a problem charging my Nokias. Then again, they would last an entire week on one charge, so it wasn't a big deal even if you were down to, let's say, 25%. You knew that would still last you long enough to get to the grid.

Apple isn't disagreeing that the patent is valid, they're just disagreeing on how much Nokia thinks it is worth.

To use my own personal experience, I see far more people with the latest hot model from Nokia, HTC, SE and associates than I ever have with any of Apple's crippled toys. I guess modern phones go well with modern networks, not the last-decade tech Apple gave us (EDGE in 2007? puhleeze). - blackinthmiddle, on 10/28/2009, -5/+4My guess would be that the vast majority of those phones come free with a cell phone plan. Sure, they're still the market leader. Heck, I think my first five or six phones were Nokias, so I'll always have a soft spot for them. However, with that being said, I don't think they're the world wide leader in the smartphone market, although I could be wrong.

- aristotle0dude, on 10/28/2009, -13/+11Are you aware the Nokia and several other companies are involved in a cartel which intends to collect 15 percent off the "sale" price of each handset from new entrants into the market? Do you realize how anti-competitive that is and that if MSFT was doing the same thing, you would be up in arms against it?
They are not charging a flat fee per handset or charging the chipset makers but rather their direct competitors a "percentage" of the sale price. It is not known if they mean the subsidized/full price charged to the consumer or the pre-subsidized price charged to the carriers.
If it is the later, that would cut Apple's margins by more than half and Nokia would be profiting from each iPhone sale despite the fact that GSM and even UTMS phones vary in price based on the inclusion or exclusion of features that have nothing to do with this patent. Other than the GSM chipset, headset speaker and microphone, the hardware is close to the iPod touch and yet Nokia is not suing Apple over it or other companies over mobile devices with WiFi. - InThePants, on 10/28/2009, -5/+2On one hand it's always refreshing to see Apple get smacked around a little...On the other, patent trolls have their own special place in hell.

No seriously Nokia is in serious financial problems, they cannot make a smart phone that can fight with new gen smart phones.
