This would be like me suing Apple because my MacBook Pro got dented when I bumped it up against something. That hasn't happened to me because I bought a laptop case that is very well padded. The problem here is that no one wants to take responsibility for their own problems. They insist on blaming other people for them. These people are a bunch of cry babies.

Did ya read that now? It wasn't about the scratches on the black plastic part, but on the screen itself. If the screen scratches so damn easily that it makes it unreadable, then you can't actually use it anymore. That's the point the class action law suit was trying to make. I found it very annoying when I bought a $200 dollar mp3 player, and after 2 days of being in my pocket it was ridiculously scratched to the point where the screen was blurry. Its one thing when your stuff gets worn after a lot of use but this was excessive. Also, I think its stupid that I should have to buy a case. What is the point of buying the smallest, sexiest mp3 player if you have to but an expensive, bulky case for it? Anyway I returned it for a full refund although it took 30 minutes of negotiating on the phone.

It looks great for about 5 seconds and then you touch it and it's awful. If they would just use the same aluminum casing on the back like they did with the new nanos and the old minis on all models, they'd stay looking nice much longer.
- elipabst, on 01/24/2009, -0/+1Actually they do lose functionality. The screen becomes so scratched that you can't read the display. Imagine if you wiped your TV with a paper towel and it scratched it so badly that you couldn't see what was playing on the screen. I'm pretty sure you'd consider that a defect. And that is exactly what happens to that version of the iPod, even wiping it with a paper towel or cotton cloth is enough to scuff it. We're not talking about standard wear and tear, this is significant scratching even with light handling to the point that it is unusable. That is a defect.
