- Dominatus, on 10/12/2007, -9/+44The name, iPhone, used for your product is trademarked by Cisco, and trademark law explicity prohibits unauthorized use of this mark. Cisco therefore demands that you cease using this name for your product.
- tom6a, on 10/12/2007, -4/+34From the cease and desist letter, "The icons and screenshot displayed on your website are copyrighted by Apple, and copyright law explicitly prohibits unauthorized display and distribution of copyrighted works. Apple therefore demands that you remove this screenshot from your website..."
There are hundreds of bloggers that have posted iPhone screenshots. What are the legal implications for all of them? It puts Apple in an odd position because I think they would be pleased with all the free blogger publicity from screenshots in blogs. It is also somewhat ironic that this comes just after the Cisco trademark suit.
My take:
Apple Challenges Bloggers Over iPhone Screenshots

- XISUPERMANIX, on 10/12/2007, -23/+45I hate Apple especially when my school got the new macs that had a circle mouse, that had to be the worst thing ever I couldn't use it for more than 10 minutes. Linux > Windows > Apple. Now I will get dug down because of all the Apple fanboys that like to distort photographs and edit really stupid homemade movies.
- Bartboy919, on 10/12/2007, -1/+22Apple computers: Beating on the little guy since so you dont have to
- dustyshadow, on 10/12/2007, -2/+21apple forgot about this little thing called "fair use"
- sleepwalkers, on 10/12/2007, -3/+22I'm not digging you down because this ***** Apple is pulling is absolutely ridiculous. This makes even less sense considering the product this person wants - and obviously really likes if they're going so far as to modify their PocketPC to look like it - isn't even out yet.
Apple is really starting to get out of hand with this *****, and it's really turning me off to their products. Maybe it's just me, though.
Every time I read something like this, I'm so much closer to dropping the platform. I'm already dual-booting my MacBook between OS X and Ubuntu, I'm about to just go with an Ubuntu/Windows combo on this thing. - h2d2, on 10/12/2007, -1/+15Here's the link to how the skin actually looks on a PocketPC:
http://forum.xda-developers.com/showthread.php?t=289523 - KanosWRX, on 10/12/2007, -6/+19Another reason I hate apple and the way they handle their products and treat there customers. They are like a dictatorship when it comes to their hardware and software. Even worse then MS in not letting other people develop for their hardware and software systems.
- black|math, on 10/12/2007, -16/+28Microsoft = Apple - 90% Marketshare
- unloud, on 10/12/2007, -11/+22Yeah, the original imac mice sucked ass, I'm glad they came to their senses with that. However, a lot has changed about Apple since then. Don't miss out on a good thing just because your first impressions were bad.

Someone else download these and reupload them ....the more the better. - windohs, on 10/12/2007, -6/+15can't you just say to apple....u are breaking copyright by using iphone name....zing!
- rockets, on 10/12/2007, -1/+10Screenshoot please, let's give them a taste of Digg power.
- Dominatus, on 10/12/2007, -1/+10You don't need to protect copyright, it's yours, you can't lose it. You need to protect trademarks, massive difference.
Second, it does not *look* like Cisco lost anything. First of all, Cisco has a trademark on iPhone, not a copyright. Second of all, the courts have not ruled on this, so it doesn't *look* like anthing. - Soulhuntre, on 10/12/2007, -7/+16Right. So is MS had sent a similar letter, you wouldnt be whining?
- joe90210, on 10/12/2007, -1/+9someone rehost the screenshot, I want to see
- goffy59, on 10/12/2007, -5/+12@ Jaq524> You apple freaks are ***** ridiculous. You cant say the same about Microsoft can you? So when apple has a right, its alright, but if Microsoft has a right its bad. Hypocritical people up on here, and your not the only one. Apple is just as evil as Microsoft, if you actually consider any company to be evil, they are all out for your money. (Coming from someone living in reality, and not siding on some stupid computer company).
- xxdesmus, on 10/12/2007, -1/+7some more mirrors,

and
http://rapidshare.com/files/11704346/wm5_iphone_skin.zip.html - Muyoso, on 10/12/2007, -6/+12Last time I checked, there were hundreds of sites that host OSX icons and screensavers and wallpapers to more make your Windows XP install look like OSX. IF they didnt sue them, they have no right to selectively enforce their copyright law. In the world of copyright law, it really is "Use it or lose it."
- Dominatus, on 10/12/2007, -4/+10Qumahlin,
First of all, it was a joke. Second of all, Cisco was not "cybersquatting" as that term applies only to domain name registrations, not trademarks. They weren't squatting on it either, as it was obtained before Apple even had an iMac, let alone an iPod.
Whether Cisco still has the trademark is up for the courts to decide, not you, or Apple. But remember, if it is found that Cisco lost the trademark than ANYONE (Motorolla, Samsung, Sony) will be able to make an iPhone. - chriskzoo, on 10/12/2007, -2/+7These are the kinds of stories, even as a stanuch Mac owner, that make me laugh when people talk about Microsoft's "monopoly." If Apple had that marketshare, they would be 1000x worse.
- ceralor, on 10/12/2007, -1/+6Much worse, considering there're public SDK's for every type of Windows out there other than the Xbox/360.
- acceptab1euname, on 10/12/2007, -0/+5No, because they're allegedly breaking *trademark* law, which is different from copyright law...any digg user with half a brain should have figured this out by now.
....zing! - sstephenson, on 10/12/2007, -0/+4'Unauthorized Dissemination of Apple Computer Copyrighted Material by MoDaCo'
Well...shouldn't you be receiving the letter from Apple Inc. now instead of Apple Computer? - FreeFlow, on 10/12/2007, -0/+4Let's ALL blog these images worldwide and then try to see how Apple tries to bully and implement lawsuits against millions of us worldwide.
Power to Digg ! - Soulhuntre, on 10/12/2007, -3/+7All kidding aside, there is almos tnothign the iPhoen does you couldn't do with a little Windows Mobiel 5 work. And since we actually have the abulity to develop for that we can do that. Unlike a closed device (cough iPhone).
- nayr, on 10/12/2007, -0/+4anyone have a link? I'm interested; and there must be SOMEONE out there with the original files.
- mpeters13, on 10/12/2007, -0/+3Apple's lawyers don't even know the name of the company they are defending. Finally, the poster of this content hasn't been accused of the correct "crime." Quite frankly, if I'd found the files, I would have posted them right back up. This irks me.
- joe90210, on 10/12/2007, -2/+5apple is one of the worst companies out there in terms of going after people who post anything about their future products, stop spewing *****.
- sleepwalkers, on 10/12/2007, -0/+3How the hell do you dilute a brand that is using a name that is trademarked in the US by another company? That comment doesn't make any sense. When you're getting sued over the use of your products name, you can't bitch about your brand being diluted by people making another cell phone look vaguely like your product which is still months away from being released. Apple is letting others distribute copyrighted photos of the iPhone, how is this any different? You're using copyrighted photos for your personal use on a phone instead of on your blog or wherever. This is *****, plain and simple. The guy didn't even host the image himself, why deliver a cease and desist?
- ductoogle, on 10/12/2007, -0/+3So who has the balls to post the link
- inactive, on 10/12/2007, -1/+4"Last time I checked, there were hundreds of sites that host OSX icons and screensavers and wallpapers to more make your Windows XP install look like OSX."

But you all got the point. - FreeFlow, on 10/12/2007, -0/+2I am just sick and tired of large corporations, governments and those with the money available to them, to spend millions on lawsuits against people like me and everyone else. If we can't bully you we will sue you....
Power to social networking and Digg ! - j_bellone, on 10/12/2007, -1/+3since 1976.
- wizeguy, on 10/12/2007, -0/+2Very true windows mobile does all of that. But... From what I understand they fixed the spell check function.
Hte Widonows splel chekc dose wierd thigns to your wrieting. - johnpaul191, on 10/12/2007, -0/+2so "the wrath of Apple Legal" is an email telling you to stop linking to their legally protected images? that headline may be a bit inflammatory.
the issue seems to be (if you read on) that the skin actually uses the icon images from Apple.com, not that the skin reminds you of the iPhone OS. - inactive, on 10/12/2007, -0/+2Up yours apple. Get the windoze files from here:
http://rapidshare.com/files/11769226/wm5_iphone_skin.zip.html - xxdesmus, on 10/12/2007, -0/+2Instructions on how to use the skin itself...
http://forum.xda-developers.com/showpost.php?p=1097832&postcount=70 - fugazi, on 10/12/2007, -0/+2And nobody has a screenshot of it?
- michaelwright, on 10/12/2007, -2/+4I can understand why Apple might want to protect the features that are exclusive to its OS and iPhone. If I were Apple, I would be afraid of knockoffs and ripoffs like the plague.
- liilliil, on 10/12/2007, -2/+4So what? They are right, cuz there was a lot Aqua-like crap (skins, themes), that was never looks like original Aqua

Be creative !
Make your OWN theme - zephc, on 10/12/2007, -2/+4A pig in makeup is still a pig underneath. On the inside, Jobs (or whoever) is snickering about this attempt at flattery, but I can see how he'd be upset about brand dilution, especially on a product that's not even out yet.
- j_bellone, on 10/12/2007, -0/+1Wow. That's actually nice. Does anyone have the Theme before it was pulled?
- mdshort, on 10/12/2007, -0/+1Why do you think?
