- FirstOne1, on 06/26/2009, -12/+148I hate people like the Owens.
- JohnsonGotOwned, on 06/27/2009, -2/+80Rule of thumb: If there's a reason to sue, no matter how stupid, somebody will do it.
- WorfoSAUR, on 06/27/2009, -0/+57Umm.. I don't know about the rest of the internets, but I just started buying my music at Amazon once iTunes raised their prices. I can get the same music for 30 cents less.
And to add to the discussion, really? Is there anywhere on the gift card that claims that a $25 gift card=25 songs? Due to taxes you couldn't even get 25 songs before the pricing switch. Are they going to sue the government too? - wastern, on 06/27/2009, -3/+46yep.
They purchased a card worth money to be spent in said store, not card worth n songs - rnawky, on 06/27/2009, -7/+39The only thing I use iTunes for now anyways is to listen to the "top 100 tracks" so I can find some good music to get off The Pirate Bay.
It's a bargain too, I just want 1 song but I always end up getting the entire discography for that artist. - geoboy, on 06/27/2009, -8/+39Yeah, really. Filing a lawsuit over this is completely ridiculous. It's like buying a $25 gift card for Target, then sitting on it for a while, and then suddenly see the price of all your favorite candy bars go up 30%. Oh, the horror! Better file a lawsuit over this rather than choose to take my business elsewhere!
Oh, and an interesting fact about iTunes gift cards: they actually cost less than the price advertised. A $25 iTunes card costs something like $24.86 (I don't remember the exact price off hand) and no tax. You never hear people complain about THAT. - thoule, on 06/27/2009, -0/+24I'd find this funny if the lawyers weren't the ones really winning...
- AriaNoelle, on 06/27/2009, -6/+30They bought the gift cards in March, and prices changed in April. Clearly these idiots don't know that prices change. Oh, and they're ***** morons. They're seriously suing because SOME songs are now $1.29 instead of 99 cents? Uh, what about the songs that went down to 69 cents??
- strictnein, on 06/27/2009, -2/+22If only this site had some sort of system that allowed you to show that, but without having to make a post...
- GelfTheElf, on 06/27/2009, -5/+25Umm.. it's a $25 gift card not a 25 song gift card
25 dollars
say it with me...
25 dollars
Which means you can use it for APPS, Movies, Audio Books, etc. too.
in fact a $99 gift card would get you 100 songs
once again.. 25 dollar (dollars) gift card. - TheBlackDart, on 06/27/2009, -6/+23the 1.29 songs don't have the DRM that the .99 cent songs used to have. they simply didn't update what it said on the card. it is not a bait and switch. these people are complaining about what is says on the card.
- geoboy, on 06/27/2009, -1/+16The cards are not advertised as "25 songs". They're advertised as "$25". And they actually cost slightly less than $25, yet you get a full $25 credit in the iTunes store.
- raackers, on 06/27/2009, -1/+15See that guys Mustache?? Incredible
- geoboy, on 06/27/2009, -2/+15Yeah, greed is totally okay as long as it's coming from "the little guy".
- inactive, on 06/27/2009, -3/+14If the card clearly says 99 cents for any song, they may have to abide by that.
- yacks, on 06/27/2009, -3/+12Then they have a good case.. If the card says that you can get 25 songs for $25, then Apple should give them 25 songs for $25 regardless if APPLE changed their prices.
- geoboy, on 06/27/2009, -1/+10BTW, the gift cards have been advertised in dollar amounts for as long as I can remember. At least as long as iTunes has been selling music videos (which cost $1.99). They've been selling music videos since when... 2005?
- Wayfarer12, on 06/27/2009, -0/+9>:~O
*iTunes
*uTorrent - inactive, on 06/27/2009, -0/+8The cards were accurate at the time they were made. These people have no case.
But no worries, I'm sure they'll inevitably be up for a darwin award at some point. Never underestimate stupid. - TheRealKrafty, on 06/27/2009, -6/+14The Owens are just loser gold diggers that try to sue anything. This is ridiculous and I can't even believe a lawyer actually accepted this case, what an idiot. I wish I could talk to the Owens somehow and let them know how IDIOTIC they are. This really heats me up. Apple is a great company and the Owens are an example of trash that creeps it's way into the ant hill and sap from the money train. Pathetic.
- tomato1324, on 06/27/2009, -4/+12this is stupid. apple can't be held responsible when other retailers like grocery stores sell gift cards from like 2 years ago. it happens all the time.
- FKnight, on 06/27/2009, -2/+10I don't give a ***** if the prices change or not. If they bought a gift card and it had the words "buy ANY song for .99" printed on it, then it's ANY song.
If the prices are variable, Apple shouldn't have printed those words on the marketing material for these gift cards. - wastern, on 06/27/2009, -1/+8key words "used to". Their pricing model changed due to what had to be extreme pressure from the record industry. If the people had been paying attention to anything they'd have known that
You look retard if you sue someone because you're just ignorant or a change in policy that happened months ago - yacks, on 06/27/2009, -2/+9You mean companies that advertise one price but charge consumers more than what they have listed?
- jollyfats, on 06/27/2009, -0/+7Using this logic, I could argue that if I bought a $50 gift card for Best Buy, I should be able to purchase any items in the store from that point forward *at the price they were when I purchased the gift card*. As long as Apple didn't state the price of a song would always be $0.99, I think this will be an uphill battle.
- VanillaBabies, on 06/27/2009, -3/+10Problem solved. Next time google first.
http://www.sustainableisgood.com/photos/uncategori ... - rickyhagen, on 06/27/2009, -2/+9lmao with that thinking... you will never be employed.
- tomato1324, on 06/27/2009, -3/+9except it's not entirely apple's fault. apple can't really be held responsible when other retailers don't discard or destroy old gift cards when they're told to. if you go into a lot of grocery stores or other places that sell itunes gift cards, they're selling really old gift cards, from way back before the new pricing structure was introduced.
- S1ngular1ty1, on 06/27/2009, -0/+6Amazon charges 1.29 for some songs too.
- dynamojoe, on 06/27/2009, -0/+6My guess as to the settlement (if there is one): $10 gift card per complainant and $2.5mill for the attorneys.
- thisthatwhat, on 06/27/2009, -1/+7So they're basically suing the system known as inflation?
- StuartGibson, on 06/27/2009, -0/+6I'm assuming because you not a self-entitled douche?
- iamacyborg, on 06/27/2009, -2/+7Okay, I have a solution here, if you don't like the companies practices - DON'T BUY THEIR PRODUCTS. Last time I checked Apple didn't operate a coercive monopoly on "music".
If you're worried about "locking someone in" to buy products from a specific company, DON'T BUY A GIFT CARD, THAT'S THE FRIGGING POINT OF THE THING. - cowsgonemadd3, on 06/27/2009, -2/+7That is why there ought to be a law that says if we deem your suing to be totally dumb and pointless you will have to pay all the court costs on both sides.
- LOGNATR, on 06/27/2009, -0/+5That's funny because I hate companies whose intention it is to steal money from customers. Guess it goes both ways.
- kreatre2007, on 06/27/2009, -1/+6I wonder if these people bothered to talk to Apple first. Probably not.
- c3rb85, on 06/27/2009, -0/+5I'm sure they can get away to this because it is a gift card to purchase something from itunes. It's not an advertisement for a specific song, and they probably have somewhere written that prices are subject to change.
- roxgod666, on 06/27/2009, -2/+6No excuse for that, but how about their actual site? The iTunes installation window even advertised it for a long time.
- TNicholson, on 06/27/2009, -5/+9Yea.. Apple totally ripped those people off hardcore, man! I'm gunna sue the ***** out them because they told me 99 cents per song but only charged me 69 cents. LIARS!
Notice how it doesn't work both ways; law suits like this are the bane of our justice system. - eatrains, on 06/27/2009, -0/+4Except that the cards are advertised as a dollar amount, not a song amount.
- r3zonance, on 06/27/2009, -0/+4"should NOT be putting "25 songs" on their card and the ones they bought even AFTER the price change claimed that."
True, but can Apple be held responsible for cards in circulation sat unsold on store shelves?
No, once Apple shows them to a retailer in this respect it isn't Apple's fault.
Maybe the store needs to be taken to task for not changing the advertising literature. - GelfTheElf, on 06/27/2009, -0/+3Where on the card does it say 99 cents per song?
Front of card just says $ amount.
Back of card:
http://images.apple.com/support/itunes/store/image ... - HonoredMule, on 06/27/2009, -0/+3On digg you can also stick to one viewpoint and still be called a hypocrite just because of /other/ diggers holding differing viewpoints.
It's so hard to remember that when I speak on digg, I represent the hive mind, and must confer with my fellow borg diggers first. - inactive, on 06/27/2009, -0/+3Taxes get applied upon purchasing content.
- usbcd36, on 06/27/2009, -1/+4False. Before the switch, a card would put $25.00 on your account, and each song would reduce that balance by $0.99, giving you 25 songs and $0.25. Maybe the card would cost more than $25 in the store, but once you put it into iTunes, there were no additional taxes.
I'm not defending the lawsuit, but you did get 25 songs out of a "$25" card. - yacks, on 06/27/2009, -0/+3@lotsofmonkeys:
In some places you can.. In Ohio, at least when I lived there, if you ordered it to go, you paid no tax on fast food..but if you ate it there you did.. - mrBitch, on 06/27/2009, -0/+3FTA (comments section) :
" .. If we were talking about an automobile company whose products suddenly burst into flames for no reason at highway speeds? Definitely...
...but a lawsuit based on, oh: "OAMG! they're not all 99 cents each anymore after I sat on the unused gift cards for (literally) months!? I just lost $18.50, you bastards!" ? - yacks, on 06/27/2009, -2/+5@VanillaBabies & Branchex:
Not all cards had song prices but some do... if they have a card that states 99 cents per song, they are entitled to songs for 99 cents a piece.. - thisthatwhat, on 06/27/2009, -0/+3Yeah, but in the end it's the lawyers who make the big bucks. Not the people suing.
- XKatsu, on 06/27/2009, -1/+4Works the other way too I saved a customer 250$ on a SLR because it was cheaper on the internal site.
