The judge could actually do something, but so far he's seems to have done nothing. Supposedly the judge is a Republican appointed by Clinton. Philip Berg is a life long Democrat (Hillary supporter).
This actually brings up lots of interesting questions. What do you think the DNC would do if the court actually ruled that The O-man was not a legal candidate? Go with Biden? Bring Hillary back? And this would present a problem for the thousands of bogus ACORN voters who have already voted for Obama. I assume their votes wouldn't be added to Hillary/Biden/Bozo the Clown total. I can imagine the uproar if the sum of two Democrats was more than what McCain got in some state (probably Ohio or Florida) but McCain beat either one on their own so all of the electoral votes go to McCain.
If they rule that Obama is not eligible, the DNC will appeal. At the rate things are going, the appeal will be heard after Nov. 4. So Obama could be "elected" on Nov. 4, but the electoral college would actually elect someone else. The various ways this could play out are just fascinating.
On the other hand, it would be nice it McCain would just win it outright.
